In so doing, the Court held that: (a) the Constitution protects “persons” ; and (b) “persons” are citizens as well as strangers, people born here and people who end up here, people here lawfully and people here unlawfully; and (c) in the area of social services, whatever benefits the government makes available to the general public cannot be kept away from a class of persons based on their immigration status or that of their parents. It is because of this ruling that Proposition 187 in California, which attempted to do via a referendum what Texas attempted to do via legislation, was invalidated. It is clear from the broad language in the Plyler case that providing an education is in the same class of social benefits as providing health care.

That evidently was not what the White House had in mind. On Monday, White House spokesman Robert Gibbs bluntly fielded reporters' repeated questions about the tax remarks. "Let me be precise," Mr. Gibbs said. "The president's clear commitment is not to raise taxes on those making less than $250,000 a year." Last Sunday, Health and Human Services Secretary Kathleen Sebelius told CNN that a government-run alternative to private health insurance was "not the essential element" of the administration's health care plan. The president's liberal Democratic allies perceived her comments as a clear sign that the White House was preparing to concede defeat on a crucial part of his plan. Not so, Mr. Gibbs said the next day, blaming the confusion on the media. He argued that a taxpayer-funded public health plan . . .

 As some AT commentators point out, this picture becomes a metaphor for ObamaCare. The elderly are left in the back, with only the kindness of the Crowleys of the world, the stand up guys, to depend on. The government has other priorities. One of the major subtexts of the health care debate involves the public's fear of indifferent, powerful bureaucrats ruling their lives. It is one thing to wait in line at the DMV to find out which other line you should wait in, in order to begin the process of waiting for multiple bureaucrats to go through the motions of processing your request. I have spent entire afternoons going through this process. But when we get to health care, waiting often means enduring pain and dysfunction longer than necessary, sometimes a worsening of the condition, and sometimes death. That's why I think this image will have genuine resonance. It captures something that older Americans in particular can relate to.

 Thanks, to the ACLU, for taking on and winning the case of a young teenage girl, strip searched at school because another student claimed she had given her Advil. What the hell is wrong with some school officials? There are times they do not seem in possession of the brains they were born with. The case, of one child's frightening experience that will, without a doubt, be with her for the rest of her life and that’s not the chilling part. School, a place for learning, had become, this day in 2003, a place for terror... With all the bullying that goes on, many of our children are in fact, already afraid to go to school. Bullying by kids is one thing but harassment by a top school official (our employee) goes beyond the pale. A little Common Sense carried out by the school higher ups, would have absolved the whole incident with dignity for everyone. But, in defense of the school's inept vice principal, in (Bush/Neocon) 2003, insanity reigned supreme and Common Sense was in short supply!

"The disclosure of this OMB memo suggests that a political decision was made to put special interests ahead of middle-class families and small businesses struggling in this recession," said House Minority Leader John A. Boehner, Ohio Republican. "It is unacceptable that this critical information was withheld and the regulatory process was abused in this fashion." The office, an independent arm of the administration whose current chief was named by President George W. Bush, is charged with looking out for small-business interests as the federal government writes rules and regulations. The memo was first reported by Dow Jones Newswire, and the intra-administration dispute could give opponents ammunition for a legal challenge to EPA's finding.

I don't know what the future holds for us but I think that Washington is beginning to understand that, while the growth of government has been increasing, it has gone nuclear in the last several years and more so in the last months. There are a lot of citizens who are realizing that if this continues we will no longer be a nation "..of the people, by the people, and for the people." A. Lincoln It was ok for Peta protests, War protests, Green protests, abortion-rights protests, etc.... but when the 'working class' protests taxation without representation and rejects the taking of their paychecks to fund a larger welfare state, well...suddenly we're extremists.
