Pelosi Health Care Bill Blows a Kiss to Trial Lawyers
merrie
by merrie  11-1-2009
While there is debate over the details, it is clear that medical malpractive lawsuits have some impact on driving health care costs higher. There are likely a number of procedures that are done simply as a defense against future possible litigation. Recall this from the Washington Post: “Lawmakers could save as much as $54 billion over the next decade by imposing an array of new limits on medical malpractice lawsuits, congressional budget analysts said today " a substantial sum that could help cover the cost of President Obama’s overhaul of the nation’s health system. New research shows that legal reforms would not only lower malpractice insurance premiums for medical providers, but would also spur providers to save money by ordering fewer tests and procedures aimed primarily at defending their decisions in court, Douglas Elmendorf, director of the nonpartisan Congressional Budget Office, wrote in a letter to Sen. Orrin Hatch (R-Utah).”

Hannibal Lecter's plan endorsed by Obama
foxyarse
by foxyarse  10-19-2009
President Obama had not released any details of his proposal, a proposal that many feared would have ended up under review by the Supreme Court, as it would seem to violate the entirety of the U.S. Constitution, not to mention being what he had campaigned against. That's when Dr. Lecter came out of his self-imposed seclusion to lend a hand. "If you simply bring me the detainees, I will house them in my secure basement facility, as many as I can accomodate, and distribute such that I cannot to...let us say...like-minded associates with proven experience in confinement methodologies.", said Dr. Lecter in a memorandum submitted to the White House yesterday. The "associates" the doctor refers to are believed to be a well trained and experienced group of psychopathic serial killers, who's basements have already been modified in a manner that would make a SuperMax seem like a child's playpen. Initial reaction was favorable, especially amongst Corrections officers from Leavenworth to Si

Nurses in Washington State file lawsuit against forced "swine flu" jab
The Infowarrior
by The Infowarrior  10-6-2009    2
"MultiCare’s unilateral implementation of this policy blatantly ignores their legal obligation to bargain with the union," said Barbara Frye, the association's assistant executive director of labor relations. "Their refusal to bargain and to cease and desist forced us to take this extraordinary measure to seek relief from federal court," she said. The union said MultiCare’s proposed plan would require unvaccinated nurses to wear a surgical mask at all times while on duty even though there is a lack of research showing that masks actually prevent flu transmission. http://www.komonews.com/news/local/63144732.html

Finally a Consumer Fights Back.
thinkingblue
by thinkingblue  10-5-2009
Although, I don’t relate to this woman's belief system, I DO relate to her as a consumer. All of us who have struggled with credit card debt and job losses know the frustrations of climbing a greased pole. The banks have been putting the screws to us for a long time. As a child, I would hear adults talking about LOAN SHARKS. On TV there were stories of bones being broken for non-payment by such LOAN SHARKS who charged exorbitant interest fees. I was glad to find out, this technique was illegal and US banks could never resort to such tactics to coerce payment. In adulthood, I learned quickly, that there were legal procedures of torture, no physical bone breaking but just as vexing. In Capitalism, the torture is mental and longer lasting. Today’s banks use teaser loans to lure us, once we’re captured by their come-ons they pounce and raise the APR's so high, that there is no escape from debt. I salute this lady who didn't take it lying down! She threw a few punches back!

Child rapist strikes again
foxyarse
by foxyarse  10-4-2009    1
The latest victim's father, a 35-year old printer from Greater Manchester, said: 'Our son was abused not only by this lad but also in effect by the British legal system that was supposed to protect him. 'I always thought people who commit such serious offences like rape automatically go to prison - yet this boy was allowed to go free. He was even allowed back onto the estate where he lived. 'In my eyes if someone commits an adult or grown up crime then they should serve an adult or grown up sentence - not be molecoddled by the courts and told to get treatment. 'My son is six years old now but as a result of what happened his childhood innocence has probably been robbed. Heaven only knows what effect it will have in him in the years to come.

Legalized Bribery in American Politics
sahara
by sahara  10-1-2009    1
Just one in a thousand adult Americans contributed $1,000 or more to any candidate in the last election, yet candidates for the 2004 presidential nomination raised more than 80 percent of their individual investments from these elites. In other words, with regard to using money to influence presidential candidates, 0.1% of Americans account for 80% of the influence. 2300 energy companies lobbied Congress between 1998 and 2004, with $984 million paid for lobbyists. Why pay a lobbyist $300,000? Because it’s a great investment, of course. Does anyone believe the legal fiction that the purpose of a lobbyist is to educate politicians on the issues? Of course not. Those huge bucks are paid out for skilled middle-men and women to discreetly (or not so discreetly) convey the message that a politician will be handsomely rewarded for screwing over his or her constituents in favor of the lobbyist’s employer.

Fugitives from justice don't get to dictate the terms of their case
Lexica
by Lexica  9-30-2009
More: Documentarians should have a wide leeway to argue their case the way they want, but there's a point at which ethical lines are crossed. Zenovich…seems to have been blinded by her contact with Polanski. Here's an example: The word "sodomy" is briefly referenced in Zenovich's documentary, but it's a somewhat ambiguous term, and it's never explained. Zenovich has fun flashing bits of the victim's grand jury testimony on the screen, but she never gets around to using this exchange from that testimony, which was made public in 2003 and published by the Smoking Gun: "Then he lifted up my legs and went in through my anus." "What do you mean by that? "He put his penis in my butt." …she also said that she had repeatedly told Polanski no, but that she was too afraid of him to resist. It's a drag to include a scene of anal rape of a 13-year-old in your moody documentary about such a Byronic figure, but it's also fairly relevant.

Reminder: Roman Polanski raped a child
Lexica
by Lexica  9-30-2009
More: Polanski was "demonized by the press" because he raped a child, and was convicted because he pled guilty. He "feared heavy sentencing" because drugging and raping a child is generally frowned upon by the legal system. …The point is not to keep 76-year-old Polanski off the streets or help his victim feel safe. The point is that drugging and raping a child, then leaving the country before you can be sentenced for it, is behavior our society should not -- and at least in theory, does not -- tolerate, no matter how famous, wealthy or well-connected you are, no matter how old you were when you finally got caught, no matter what your victim says about it now, no matter how mature she looked at 13, no matter how pushy her mother was, and no matter how many really swell movies you've made. Roman Polanski raped a child. No one, not even him, disputes that.

Home-Schooler Ordered to Attend Public School
thisnamecantbetaken
by thisnamecantbetaken  9-14-2009    8
According to court documents filed in Laconia, a small city in the central New Hampshire's Belknap County, Amanda is a well-adjusted child whose parents were divorced in 1999. The mother has primary physical custody of Amanda, whom she has home-schooled for several years in math, English, social studies, science, handwriting, spelling and the Bible. The course load, except for the Bible study, is similar to what public students get and the mother's home schooling has "more than kept up with the academic requirements of the school system," the judge's statement said. " believes that exposure to other points of view will decrease Amanda's rigid adherence to her mother's religious beliefs and increase her ability to get along with others and to function in a world which requires some element of independent thinking and tolerance for different points of view," Judge Sadler's ruling said.

The Real Issue: Who Should Control HealthCare? You Or Washington
merrie
by merrie  9-12-2009    1
These areas are primarily marginal fixes to the current health care system and do not entail a major restructuring. Reforms where there may be common ground include: subsidizing low income American citizens and legal residents; requiring all Americans to have health care insurance; reform of medical malpractice tort system; permitting inter-state competition among health insurers; portability of insurance; and promoting healthy lifestyles. Obviously, the devil will be in the details of crafting these reforms. If the real issue of reform was to reduce the overall cost of medical care in America, the health care reform debate would center on medical malpractice tort law, promoting healthy lifestyles and dealing with the high end of life costs. Medical malpractice insurance and defensive medicine account for approximately 18 percent of health care costs. Obesity accounts for approximately 9 percent. Alcoholism and smoking account for another large percent.

Goldman Profits. Do We Lose?
disenchantedcitizen
by disenchantedcitizen  9-11-2009    2
From tech stocks to high gas prices, Goldman Sachs has engineered every major market manipulation since the Great Depression - and they're about to do it again. In a brilliant article that appears in the current issue of Rolling Stone magazine, "The Great American Bubble Machine" by Matt Taibbi, we can see in all its gory and horrendous detail what is so wrong with "the invisible hand of the marketplace." From the article: “any attempt to construct a narrative around all the former Goldmanites in influential positions quickly becomes an absurd and pointless exercise, like trying to make a list of everything. What you need to know is the big picture: If America is circling the drain, Goldman Sachs has found a way to be that drain — an extremely unfortunate loophole in the system of Western democratic capitalism, which never foresaw that in a society governed passively by free markets and free elections, organized greed always defeats disorganized democracy.”
