 It observed further that during the suspension of the writ of habeas corpus, citizens may be only held without charges, not tried, and certainly not executed by military tribunals. After all, the writ of habeas corpus is not the right itself but merely the ability to issue orders demanding the right's enforcement. It is important to note the political environment of the decision. Post-war, under a Republican Congress, the Court was reluctant to hand down any decision that questioned the legitimacy of military courts. The President's ability to suspend habeas corpus independently of Congress, a central issue, was not addressed probably because it was moot with respect to the case at hand. Though President Lincoln suspended the writ nationwide on September 24, 1862, Congress ratified almost six months later, on March 3, 1863. Milligan was detained in 1864, well after Congress formally suspended the writ. That notwithstanding, military jurisdiction had been limited.

Accordingly, without these important safeguards, illegal aliens would probably receive this subsidy. The bill does limit eligibility to individuals who are "lawfully present in a State in the United States," but that language would be ineffective to prevent handouts to illegal aliens. (Sec. 242(a)(1)). Under U.S. immigration law, someone's status as an illegal alien is not determined by lawful presence in a State. As a result, this language will have no effect in preventing illegal aliens from receiving the credit. Critics suggest that if the intent of the bill is to preclude illegal aliens from receiving this subsidy, the current language is woefully inadequate and would have to be dramatically revised. At the same time as Congress is considering burdening taxpayers with the cost of health care . . .

 So Sen. Kennedy wants a re-do on the Mass. law now that it *might* affect the political dynamics in the Senate. I know he carries a lot of weight and influence but what was good in 2004 should be good enough for 2009. I'm sorry for the Senator's terminal illness. I wouldn't wish that on anyone. However, trying to change the Mass. laws to allow for unfair manipulation of the process (NOW) and supply a link for his health care legacy is pretty low. It's good to see the Dem. Governor balking. I hope he allows the process to take it's course and the outcome be lawful.

 The photo and the pastor's comments pretty much speak for themselves. I probably wouldn't have clipped this except for the final paragraph in the clip -- "we are definitely trying to open up dialogue." This baffles me. I wonder what they're actually trying to accomplish -- presumably the primary purpose of the sign is illocutionary in nature. To the pastor, I would point out that "All things are lawful for me, but not all things are beneficial" (1 Cor. 6.12). Is this beneficial?

 President Obama on Monday called the action "not legal," and claimed that Zelaya is still the legitimate president. There was a coup all right, but it wasn't committed by the U.S. or the Honduran court. It was committed by Zelaya himself. He brazenly defied the law, and Hondurans overwhelmingly supported his removal (a pro-Zelaya rally Monday drew a mere 200 acolytes). Yet the U.S. administration stood with Chavez and Castro, calling Zelaya's lawful removal "a coup." Obama called the action a "terrible precedent," and said Zelaya remains president. In doing this, the U.S. condemned democrats who stood up to save their democracy, a move that should have been hailed as a historic turning of the tide against the false democracies of the region. The U.S. response has been disgraceful. "We recognize Zelaya as the duly elected and constitutional president of Honduras. We see no other," a State Department official told reporters.
