Think very carefully about what you just read: Obama has given an international law enforcement organization that is accountable to no other national authority the ability to operate as it pleases within our own borders, and he has freed it from the most basic measure of official transparency and accountability, the FOIA. giving Interpol free rein to act within this country could subject U.S. military, diplomatic, and intelligence personnel to the prospect of being taken into custody and hauled before the International Criminal Court as "war criminals."

Being constrained by the Fourth Amendment, FOIA, and other limitations of the Constitution and federal law that protect the liberty and privacy of Americans is what prevents law-enforcement and its controlling government authority from becoming tyrannical. On Wednesday, however, for no apparent reason, President Obama issued an executive order removing the Reagan limitations. That is, Interpol's property and assets are no longer subject to search and confiscation, and its archives are now considered inviolable. i'm not even sure that it's constitutional, but if it is, it most certainly is a senate rule. i don't see why the majority party wouldn't put this in every bill. if you like your law, you most certainly would want it to have force for future senates. i mean, we want to bind future congresses. this goes to the fundamental purpose of senate rules: to prevent a tyrannical majority from trampling the rights of the minority or of future congresses. According to page 1001 of the Reid bill, the purpose of the Independent Medical Advisory Board is to "reduce the per capita rate of growth in Medicare spending." For any fearmongers out there tempted to call an unelected body that recommends Medicare cuts a "Death Panel," let me be clear. According to page 1004, IMAB proposals "shall not include any recommendation to ration health care"--you know, just like the bill says there's no funding for abortion. Paging Sarah Palin: the death panel is unkillable.

POPSStates Reassert Sovereignty With Legislation September 21, 2009 Although the resolutions are not legally binding, Tenth Amendment Center founder Michael Boldin said they “serve notice” that states will no longer automatically enforce federal mandates in areas they believe the central government has no constitutional authority. Montana’s first-in-the-nation law reasserting state authority with the regulation of firearms manufactured and sold within state boundaries was soon followed by a similar law in Tennessee. Officials from the Bureau of Alcohol, Tobacco, Firearms and Explosives have already sent letters to gun dealers and federal permit holders in both states telling them to ignore the state law. A court battle is next. Nearly 20 other states have similar legislation in the works, including directives to their governors to order National Guard troops home from Iraq and Afghanistan. Next year, Arizona will have a state constitutional amendment on the ballot that allows residents to opt out of any national health care program.

POPS Grand Jury Seeks CAIR Records Among the book's specific allegations, CAIR officials grossly exaggerate their membership rolls and the depth of their domestic financial support. In addition, they actively thwart law enforcement counterterror investigations. Following the release of the book, four congressional Republicans sought an investigation into the book's claims that CAIR seeks to place interns on committees dealing with the judiciary and homeland security. Thus far, CAIR has minimized and ridiculed the book's findings, but has not alleged any of it is false. CAIR won a temporary restraining order requiring that the Gaubatzes return 12,000 pages of documents. WorldNetDaily, publisher of Muslim Mafia, posted a story November 24th claiming that FBI agents served a grand jury subpoena on the Gaubatzes' attorney. The move came as the attorneys were about to comply with the judge's order and give the documents back to CAIR.

POPSAmerica's regression Pew Poll, today: Public opinion about the use of torture remains divided, though the share saying it can at least sometimes be justified has edged upward over the past year. Currently just over half of Americans say that the use of torture against suspected terrorists in order to gain important information can either often (19%) or sometimes (35%) be justified. This is the first time in over five years of Pew Research polling on this question that a majority has expressed these views. Another 16% say torture can rarely be justified, while 25% say it can never be justified.

POPSExecutioned Police Officers Re-Opens Huckabee's Clemency Record Huckabee was expected to discuss the Clemmons case Monday night during an interview with Fox News Channel's Bill O'Reilly. Clemmons was among 1,033 people who were pardoned or had their sentences reduced during Huckabee's 10 1/2 years as governor, a number that far surpasses that of his three predecessors combined. Bill Clinton, Frank White and Jim Guy Tucker granted 507 clemencies in the 17 1/2 years they served. Beebe, Huckabee's Democratic successor, has issued 273 commutations and pardons since taking office in January 2007—all but one of them were pardons after the completion of the inmates' prison terms.
