Eviscerating Medicare: In addition to reducing future Medicare funding by an estimated $500 billion, the bill fundamentally changes how Medicare pays doctors and hospitals, permitting the government to dictate treatment decisions. Sec. 1302 (pp. 672-692) moves Medicare from a fee-for-service payment system, in which patients choose which doctors to see and doctors are paid for each service they provide, toward what's called a "medical home." (The bill specifies that patients may have to settle for a nurse practitioner rather than a physician as the primary-care provider.) Sec. 1114 (pp. 391-393) replaces physicians with physician assistants in overseeing care for hospice patients. • Secs. 1158-1160 (pp. 499-520) initiates programs to reduce payments for patient care to what it costs in the lowest cost regions of the country. POPSAmnesty Now! Let’s play a hypothetical game. Let us assume that Gutierrez’s bill passes, and he achieves his major goal of a general amnesty. The 12 million aliens currently residing in the country illegally suddenly find themselves free to stay, become card-carrying members of the Democratic Party, and live happily ever after. What happens to the next person who steals across the border? History has shown us that, after an amnesty, the rate of illegal border crossings increases. After the last amnesty bill in 1986, the US experienced a flood of new illegal aliens crossing the border. In the twenty-year period between 1985 and 2005, the number of illegal residents soared from an estimated 2-3 million to about 11 million. It is only human nature that, upon hearing of an amnesty, people would, predictably, risk all to come to the US by any means and simply wait out their chance in the hopes of catching the next one.

In so doing, the Court held that: (a) the Constitution protects “persons” ; and (b) “persons” are citizens as well as strangers, people born here and people who end up here, people here lawfully and people here unlawfully; and (c) in the area of social services, whatever benefits the government makes available to the general public cannot be kept away from a class of persons based on their immigration status or that of their parents. It is because of this ruling that Proposition 187 in California, which attempted to do via a referendum what Texas attempted to do via legislation, was invalidated. It is clear from the broad language in the Plyler case that providing an education is in the same class of social benefits as providing health care.

Even though the undercover young woman is not really a prostitute and there are no El Salvadoran girls here either, this could still meet the legal standard for conspiracy to commit these various crimes. At a bare minimum, depending on the state, it likely fulfills the elements for the crime of attempted conspiracy, which usually carries the exact same penalty as the underlying crimes themselves (prostitution, tax fraud, etc.). What’s important about prostitution and human trafficking is that they are specific triggers for the Racketeer Influenced and Corrupt Organizations Act, better known as RICO. The RICO law is designed to enable the Justice Department to go after criminal enterprises. It defines “racketeering activity” as including importing illegal aliens for immoral purposes, falsifying identification documents and immigration papers, mail and wire fraud, and . . .

There are now more than 30 million American citizens who cannot get coverage. ... We spend 1 1/2 times more per person on health care than any other country, but we aren't any healthier for it." As to his claimed number of uninsured, e's temporarily removed the illegal aliens to lower the number from 47 million to 30 million. But he's still lying to say 30 million "cannot get coverage." Again, 18 million of these make more than $50,000 a year and can afford health care but choose not to purchase it. And millions more have access to government programs and don't access them, which, incidentally, doesn't bode well for Obama's mandated universal coverage plan. And if he has such bipartisan intentions, why did he spend a significant part of his speech demonizing his opponents and misrepresenting their motives?

Reforms where there may be common ground include: subsidizing low income American citizens and legal residents; requiring all Americans to have health care insurance; reform of medical malpractice tort system; permitting inter-state competition among health insurers; portability of insurance; and promoting healthy lifestyles. Obviously, the devil will be in the details of crafting these reforms. If the real issue of reform was to reduce the overall cost of medical care in America, the health care reform debate would center on medical malpractice tort law, promoting healthy lifestyles and dealing with the high end of life costs. Medical malpractice insurance and defensive medicine account for approximately 18 percent of health care costs. Obesity accounts for approximately 9 percent. Alcoholism and smoking account for another large percent.

Smith concludes: The number of Americans who are poor, sick, and uninsured for a lengthy period of time is a relatively small number, about 4 million individuals, adding that the 46 million figure also includes about 12 million illegal aliens. Now this leads me to another question. If 4 million is the more accurate number, then the cost of $1.2 TRILLION seems even more exorbitant! We can’t find a way to help 4 million Americans so they can get health care without spending $1.2 TRILLION! (FAIR's explanation of the SAVE System). Accordingly, without these important safeguards, illegal aliens would probably receive this subsidy. The bill does limit eligibility to individuals who are "lawfully present in a State in the United States," but that language would be ineffective to prevent handouts to illegal aliens. (Sec. 242(a)(1)). Under U.S. immigration law, someone's status as an illegal alien is not determined by lawful presence in a State. As a result, this language will have no effect in preventing illegal aliens from receiving the credit. Critics suggest that if the intent of the bill is to preclude illegal aliens from receiving this subsidy, the current language is woefully inadequate and would have to be dramatically revised. At the same time as Congress is considering burdening taxpayers with the cost of health care . . .

POPSACLU Files Lawsuit Against Sheriff Joe Arpaio's Office and his son is a US citizen. He was also an employee of Handyman Maintenance at the time of the raid. The lawsuit claims that the Mora’s were detained for over 3 hours and denied food and water during this time. It also alleges that the experience was “humiliating” for Julian Mora since he is a diabetic and was forced to urinate in the parking lot. Almost lost in the story is the fact that the raid resulted in the apprehension of 60 illegal aliens, while the company itself did work for the Maricopa County government. The strategy for silencing Arpaio seems clear; Investigate and sue him into submission. An anti Arpaio website claims that the Sheriff’s office has been involved in over 5000 lawsuits and proclaims that 42 million has been spent defending Arpaio and his department. This is used as a justification for removing Arpaio, whether his efforts are sanctioned under the law is irrelevant to these groups. . . .

POPSSwat Team for Change Upon hearing the disturbing news, America's ''Swat Team for Change"--President Obama, Nancy Pelosi, and Harry Reid--immediately convened an emergency meeting in the basement of the White House to discuss this new economic catastrophe and to develop an effective counter strategy. A ''War room" was set up to meet the challenge that could destroy the Obama presidency. Speaker Pelosi was quoted as saying, "Living to be 78 is un-American! Old people are doing this because they are racists who hate our black president!" Harry Reid was a tad more optimistic when he said, "This war is NOT lost. America needs a surge in the mortality rate among people aged 55-78, and we intend to implement such a surge in bill 3200." President Obama was shooting hoops and not available for comment.
