We can argue about the political pressures Bush was under, but the simple truth of the matter is that we should have created a process for dealing with these detainees long ago. The Military Commissions Act was this solution, establishing military commissions to establish the guilt or innocence of these detainees, but it came far too late in Bush’s administration to do any good (and was absurdly deemed unconstitutional by the Supreme Court in yet another decision ignoring the constitution completely). And now our policy toward Guantanamo Bay is a mish-mash of conflicted and largely politically-motivated pap geared more, I think, toward pandering and backside-covering than any national security strategy. Some of the detainees are getting trials in civilian US courts. Some are being shipped off to Pacific islands for continued detention.

Two of the three detainees convicted of war crimes have served their sentences and today they are free men back in their home countries. But the more than 200 that remain inside the detention center have never been convicted, or in most cases even faced charges. The day after his inauguration, Mr. Obama ordered an evaluation of all the detainees to determine who should face criminal prosecution. Administration officials estimate that roughly a quarter of the remaining detainees will be recommended for trial in criminal courts. In a preliminary report submitted to Mr. Obama in July, the Detention Policy Task Force recommended the approval of evaluation criteria developed by the Department of Defense and the Department of Justice. The task force stated its preference for trials in the federal courts, but added the decision would be based in part on "evidentiary issues" and "the extent to which the forum would permit a full presentation of the accused's wrongful conduct."

I hope someone gives me her book for Christmas. I doubt that she has Presidential aspirations but I believe she is hoping to give encouragement and energy to the conservatives of America who have, honestly, lost all hope that America can rebound from the free-fall over the last several years. As much as I appreciated President Bush (and admired his wife) he was too nice those last several years and allowed the press to bash him mercilessly. Plus I did not agree with the illegal immigration issue. I wish he had pressed more for energy independence but I believe he was worn down and out by the faulty intelligence, the back-biting within his Cabinet, dealing with the causalities of the wars in Afghanistan & Iraq, etc. A person can only handle so much without physically and mentally drawing down. Palin is fresh, feisty, fearsome and committed to her conservative values. That's what people hear..PLUS all the attacks from the MSM which make them like her more!!

Holder has announced a tepid probe into some of the possible "excesses" committed by a few CIA interrogators, while letting the true architects and perpetrators of an elaborate, deliberate, inherent system of torture get off scot-free. Glenn Greenwald has many of the details here and here, among them the telling – and damning – fact that Obama and Holder have apparently decided that the "torture memos" prepared at the White House's order should be considered "settled law;" that is, only those agents whose tortures might have gone a bit beyond the already heinous tortures "allowed" by the White House memos are to be investigated for possible prosecution. As long as you stayed within the gruesome "guidelines" of the White House torture memos, then your atrocities are now to be considered "legal." This is yet another open reinforcement of the long-established covert practice of what we might call Nixon's Law: "If the president orders it, it cannot be illegal."

POPSMore CIA Torture Tactics Revealed So, now we hear we were poking out eyes with power drills. But, (sniff), don't think we're bad people or anything. Several points come to mind. 1. The facts could be even worse than the reports. 2. The victim here was in a secret prison for 4 years, at least...but he's never had a trial, a lawyer, charges made against him...all we know is that men threatening to poke out his eyes with a power drill say he is a bad man. And them? Black opt torture with no justice in secret prisons...they are the good men? 3. I guess this means the torture trials are coming. 4. One "hope" of freedom, knowledge and democracy is that it MAY be self-healing. If these things were kept secret, the abuses would get worse. Somethings really sick and twisted in this USA post-WWII era of non-stop, endless worldwide wars. How long can they tell us this is for freedom and democracy? (Or to rid the world of nasty drugs, coming up as an excuse now and then). Yep. Freedom isn't free.
