SCOTUS Admits Blunder on UCMJ, But Says "Nevermind"
merrie
by merrie  10-1-2008
and shows again, how Obama's model judges pull constitutional law from thin air. That was spectacularly clueless, and one of the many occasions on which Obama has demonstrated that for all his fine degrees from Columbia and Harvard Law, he's ignorant of world history. First, no one at Nuremberg was permitted to file a habeas corpus petition in the American courts. Second, the Military Commissions Act provides substantially greater procedural and substantive protection than what any of the Nuremberg defendants had. Rights for foreigners accused of being terrorists that even our own service personnel don't get. A "living, breathing" Constitution whose answers, are blowin' in the wind. You do get an indirect vote on whether that's what you want — but you have to cast it through your choices for POTUS/VPOTUS and (even less directly) U.S. Senators. Judicial appointments are just one more issue on which this year's presidential election presents you with a stark, vivid choice.

The Democratic Party and Clean Elections

by renerodz  9-28-2008
One of the reasons I'm disillusioned by the democrats and am not jumping on their cheerleading team - they play dirty and like to keep the system rigged. If you are a democrat please support clean, open and "democratic" elections.

Having Their Cake and Eating It Too
AtlLiberal
by AtlLiberal  9-28-2008
From the article: "Let's imagine that the Alliance Defense Fund and its clerical clients were to persuade the Supreme Court to overturn the Johnson amendment's ban on political endorsements from the pulpit. At that point, what would prevent wealthy ideologues from making tax-exempt contributions to sympathetic pastors' churches for the express purpose of engaging in partisan electioneering? For that matter, what would prevent ambitious pastors from soliciting just such contributions and then using them to bind like-minded ministers into powerful political machines?"

Democrats Sue Michigan G.O.P. on Voter Issue
zasel
by zasel  9-17-2008
The Michigan GOP is drawing up plans to challenge residency eligibility at the polls, by combing the home foreclosure records. It's not bad enough that these unfortunate people were thrown out of their homes due to foreclosure, but now their right to vote is going to be unduly challenged. This group is willing to do anything to make sure poor and working class people who mostly vote for the Democratic candidates, do not get to actually vote.

Alaska Chooses Largest Gold Mine Over Clean Water
papananook
by papananook  9-6-2008
Suggest you read it all--Sarah Palin supported this minin project--ooops, there go the Salmon in that area...some more info on the "Independent" Alaskan voters: But on Aug. 26, Alaskans voted down a ballot measure that proponents had cast as crucial to the future survival of Bristol Bay salmon. Ballot measure 4, which survived a challenge that went all the way to the state Supreme Court to remain on the state's primary ballot, would have prohibited large metal mines from contaminating salmon streams and drinking water sources. Though by law the ballot measure couldn't name a specific project, everyone knew it was aimed at the proposed Pebble Mine, which if developed as planned would be North America's largest open pit gold mine, also mining copper and molybdenum (a crucial element in steel).

Rights Group Suing AT&T for Spying Will Sue Government Too
Kelika
by Kelika  8-23-2008    1
"Cohn admits the government has many sovereign immunity defenses that can protect it from lawsuits, but says they aren't insurmountable and that the program clearly violates the Fourth Amendment. As for the unexpectedly long-lived suit against AT&T, the government and the EFF are discussing when and how the government will attempt to have the case dismissed using the amnesty provision. The EFF wants to challenge the legality of the amnesty before it is actually applied, while the government prefers to have the case dismissed first -- then have the EFF fight the dismissal. Lawyers for both sides will meet with the judge in the case in early September, setting a likely date for the next court appearance in December."

‘Hook’ Imam Denied Extradition Appeal: To Stand Trial In U.S.

They also say he assisted extremists who kidnapped 16 foreign tourists in Yemen in 1998. Three British tourists and one Australian visitor were killed in a shootout between Yemeni security forces and the captors. Al-Masri also is accused of facilitating terrorist training in Afghanistan. The former imam at London’s Finsbury Park Mosque, al-Masri is one of Britain’s best-known Islamist radicals. The Egyptian-born preacher is blind in one eye and has hooks in place of the hands he says he lost fighting Soviet troops in Afghanistan in the 1980s. Under his leadership the Finsbury Park mosque became a magnet for extremists. Its worshippers included Sept. 11 conspirator Zacarias Moussaoui and “shoe bomber” Richard Reid.

Court Moves To Charge Sudanese President al-Bashir With Genocide
merrie
by merrie  7-15-2008    1
"The solution to problems and the current situation in Darfur is not completely independent from the work of the International Criminal Court." The German chancellor said she and Ban also discussed instability in Zimbabwe and the challenge of supporting Africa as food and fuel prices skyrocket. Merkel said that Germany had pledged €600 million (US$954 million) in emergency aid to African nations struggling to deal with rising prices. "Naturally, Germany is strongly committed to development aid." Ban was in Germany for a two-day visit that will also take him to Bonn, where several U.N. programs have their headquarters.

This is not happening in China, Zimbabwe or the former Soviet Union; Our government wants to put on a show of democracy at work. Circus would be more like it. A circus of caged, tortured and worse. This government, if one can call it that, must be very afraid. I am afraid of this kind of " institution ". Sooner, rather than later, we who oppose this sham, might also get into the " show ". Patriotism is what they call that! No wonder the Arabs, and many others, have trouble believing in American Democracy. Are you having trouble yet? Or do you need more?

The Terrorists Have Just Won

The REAL terrorists have just stripped away our 4th amendment rights. The "terrorists" we "fight" couldn't have done it better themselves. In 20 years I will look back and recount this day as the day America fell, the day citizens saw their hard-fought rights stripped away in an attack on our liberties that pales in comparison to the attacks of 9/11.

Court Ruling Will Expose Viewing Habits of YouTube Users
sahara
by sahara  7-3-2008    1
The Logging database contains: for each instance a video is watched, the unique “login ID” of the user who watched it, the time when the user started to watch the video, the internet protocol address other devices connected to the internet use to identify the user’s computer (“IP address”), and the identifier for the video. In any event, the court ordered production of not just IP addresses, but also all the associated information in the Logging database. Whatever might be said about 'an IP address without additional information,' the the AOL search history leak fiasco shows that the material viewed by a user alone can be sufficient to identify the user, even with neither a login nor an IP address. The Court's erroneous ruling is a set-back to privacy rights, and will allow Viacom to see what you are watching on YouTube. We urge Viacom to back off this overbroad request and Google to take all steps necessary to challenge this order and protect the rights of its users.

Michael Savage Wants to "Hang" JAG Officers
cptenaud
by cptenaud  6-22-2008    4
This utter bullshit because it's officers like Lt. Cmdr. William C. Kuebler, "a self-described born-again Christian and conservative who has 'never voted for a Democrat'" who have the courage to challenge these kangaroo courts "designed to get criminal convictions" with "no real evidence," or the the fact that military prosecutors "launder evidence derived from torture." I suppose Savage also wants Lt. Cmdr. Charles D. Swift hanged. As the NYT reports, Swift helped "take the case of Salim Hamdan, a former driver for Osama bin Laden, to the Supreme Court. The ruling in 2006 invalidated the Bush administration's first military commission system." Lt. Col. Yvonne Bradley needs execution too, I suppose, for defending a "British resident accused of plotting with al-Qaida to bomb apartment buildings in the United States." Marine Corps Maj. Michael D. Mori defended Australian David Hicks an accused al-Qaeda trainee.

New rights for terror detainees as deeply split Supreme Court rules
papananook
by papananook  6-19-2008
It isn't hard to figure out why the right wingers are all in an uproar over this--you see it gives rights to human beings that aren't Amerikans and that's unthinkable because if we actually see our "enemies" (anyone not Amerikan or kissing our leader's butt) as HUMAN BEINGS and not just some vile brown monkeys like we're supposed to. How sad is that? What has Amerika become? Are we so vile as to deny basic rights to everyone not born here? And when theyu are given the barest of rights--not freedom, juist a chance at Justice--The bile that comes from the Right wing, from Scalia to Giuliani to Limbaugh is so odious, I may gag.
