State’s high court dismisses juvenile convictions
disenchantedcitizen
by disenchantedcitizen  10-30-2009    4
Is there any segment of the judicial system that can be trusted? I’m willing to bet this is not the only judge who uses the judicial system to line his pockets. We have been taught to trust the police, trust the judges and this is what we learn of real life. This society is going to hell too damned fast.

Defense dept. opposed to franken's anti-rape amendment
ofcapri
by ofcapri  10-22-2009
The amendment, sponsored by Sen. Al Franken (D-Minn.), is intended to address the type of Kafka-esque treatment Jamie Leigh Jones received from the U.S. justice system after she was gang-raped by fellow KBR workers. The defense contractor argued that her employment contract required that her claim be heard in private arbitration rather than in open court. Was Joe Wilson Right? Free Health Care for Illegal Aliens!
merrie
by merrie  10-8-2009    3
and that every professor of constitutional law knows about , called Plyler vs. Doe (1982), the Court ordered Texas to make the same education available to illegal immigrants as it does to citizens. In so doing, the Court held that: (a) the Constitution protects “persons” ; and (b) “persons” are citizens as well as strangers, people born here and people who end up here, people here lawfully and people here unlawfully; and (c) in the area of social services, whatever benefits the government makes available to the general public cannot be kept away from a class of persons based on their immigration status or that of their parents. It is because of this ruling that Proposition 187 in California, which attempted to do via a referendum what Texas attempted to do via legislation, was invalidated. It is clear from the broad language in the Plyler case that providing an education is in the same class of social benefits as providing health care.

Will Dog Fighting Videos be Protected by Freedom of Speech?
JackieDel
by JackieDel  10-7-2009    2
If the Supreme Court rules to uphold the conviction of Stevens, the law will be reinstated and animals will once again be protected from people who make money from their suffering. It seems like it should be an easy decision for the Supreme Court, but since the concept of free speech has come into question everyone from book publishers to movie producers, photographers, artists and journalists have gotten involved. They have taken animal cruelty out of the equation and replaced it with their own interests that they believe will be damaged if Stevens loses. Even the ACLU has gotten involved. The New York Times went as far as filing a “brief” in support of Stevens. They said, “The 1999 law imperils the media’s ability to report on issues related to animals.” Media publications cite that they are concerned that hunting and fishing magazines will be censored and general reporting on animal issues will be limited.

Chapter 7 Bankruptcy

Chapter 7 bankruptcy, New York, is liquidation bankruptcy also known as straight bankruptcy. It is the simplest and quickest form of bankruptcy available. Chapter 7 bankruptcy cases are filed by debtors who incurred debts for personal, family, or household purposes. Often more than not, these individuals are in dire financial situations with no realistic chance of repaying the debts within a reasonable time frame.

Life In Prison For Judge Accused Of Spanking and Sexual Abuse Of Inmates?
merrie
by merrie  10-5-2009
The National Association for the Advancement of Colored People, a leading civil rights group, has defended Thomas and claims race is behind his prosecution. Thomas and his attorney blame the charges on politicians who don't like him. ‘There is no doubt that people assisted these inmates in telling these lies on me,’ Thomas said in April. In an echo of sex allegations made against black Supreme Court justice Clarence Thomas, Thomas's lawyer called the indictment ‘a high-tech lynching’. ‘They don't like uppity black folks, and that's what they consider Herman,’ Clark added. Chief Assistant District Attorney Nicki Patterson said authorities began looking at Thomas after he changed a jail sentence in 2006 for his cousin, former Mobile County school commissioner David Thomas, even though the case was being handled by another judge. Other cases that Thomas had taken over from other judges without their approval soon surfaced , she said.

The Fraud Of GOP Tax And School Choice Policy Shown In Arizona

In the mid to late 1990s, a group of dogmatic conservative Republican leaders, led by Arizona Congressman Trent Franks and a leading GOP school reform and voucher advocate, Lisa Graham Keegan, saw an opportunity to implement some of the pet school reform projects of national conservative Republican think tanks in the Arizona school system as test cases. The results were as predictable as they are bleak:

Illegal immigrant muslim tries to bomb Dallas building

Does anyone see a pattern here. Muslim enters the U.S. illegally, then plots to set off bombs. I would be very curious how this vermin entered. My bet would be the Mexican border. You know, the one the democrats refuse to seal and protect. OK, so for every one of these rats we capture how many others are there out there living in those muslim enclaves, hatching plots? They say America doesn't export anything anymore. I suggest exporting muslims. Send them back to the s#@*hole they came from.

Obama: Less State Secrets
citizenbfk
by citizenbfk  9-23-2009
In the Bush Era many bad policies (torture, secret prisons, wiretappings, etc.) were covered up by being declared "state secrets." In a few court cases in the new Obama Administration, this was still the case because that was still the way the law, administrative procedure was. Now it's changed. No more easy covering up of wrongdoing by declaring it is a "secret." The new procedures certainly require more justice and more review.

Is Bagram Obama’s New Secret Prison?
papananook
by papananook  9-16-2009
What has happened to the Geneva Conventions? This omission of screening on capture - which has applied at Bagram ever since - came about because, under instructions from the highest levels of government, the military was obliged to shelve its plans to hold competent tribunals under Article 5 of the Geneva Conventions, despite the fact that they had been pioneered by the US, and had been used successfully in every war from Vietnam onwards. Held close to the time and place of capture, these tribunals (as opposed to the CSRTs, which mockingly echoed them), comprise three military officers, and were designed to separate combatants from civilians seized in the fog of war, in cases where it is not obvious that prisoners are combatants (when they are not wearing a uniform, for example), by allowing the men in question to call witnesses. During the first Gulf War, around 1,200 of these tribunals were held, and in nearly three-quarters of the case, the men were found to have been wrongly

Programs in Several States Could Address Medical-Malpractice Abuses
merrie
by merrie  9-11-2009    1
Today the hospital encourages employees to report mistakes, and also to report issues that might lead to mistakes. A committee of peers reviews serious incidents. If the panel determines that a mistake has occurred, the hospital and doctors apologize. In addition, the University of Michigan compensates the patient or the family. The costs to such a review are high, said Mr. Boothman. They are included in the hospital's risk-management budget, which has grown to more than $3 million annually, up from $500,000 in 2001. But claims against the hospital have been reduced to 106 in 2008 from 121 in 2001. Andrew Muth, an Ypsilanti, Mich., plaintiffs lawyer, said the hospital's project achieves the primary goal of litigation: getting to the truth quickly and efficiently. In the second initiative, plaintiffs lawyers in participating states must retain medical experts who have practiced in the same specialty area as the physicians accused of malpractice.
