POPSPennsylvania ‘Firearms Freedom Act’ Legislation Introduced While the bill seems to focus solely on federal gun regulations, it has far more to do with the 10th Amendment’s limit on the power of the federal government. It specifically states: The regulation of intrastate commerce is vested in the states under the 9th and 10th Amendments to the Constitution of the United States, particularly if not expressly preempted by federal law. Congress has not expressly preempted state regulation of intrastate commerce pertaining to the manufacture on an intrastate basis of firearms, firearms accessories, and ammunition. Rohrer, in a recent letter to Pennsylvania House Members, addressed the issue of the commerce clause... Read more here

POPSIgnore the Feds! Tenth Amendment Center Pledge for the Constitution
The Constitution of the United States was a revolutionary document. "Before it, no government in history had seen its duties and restrictions so clearly and carefully defined" When it was being considered for ratification, there was strong opposition from famous American figures that included George Mason and Patrick Henry. "One major reason for this was a fear of too much power The founding generation spent their lives toiling under a tyranny - a government without limits. When the Constitution was written, it was done to limit the power of government. It was created under the principle of popular sovereignty - that 'We the People of the Several States' created the government, and all powers not delegated to it, were retained." Depending on how you count them, the People delegated approximately 35 powers to the federal government and not included in those powers are national health care, the creation of free speech zones, federal gun regulations, the war on drugs, and more.

POPS Is Obamacare Constitutional? “The Tenthers.” I recently started seeing a few references to this term in the standard places, Alternet, ThinkProgress, and elsewhere. But now it seems to have come from on high like the NeoCons did with every new buzzword during the Bush years. In fact, its usage has come on so fast and so regularly that someone over at the Washington Times picked up on the newly-approved jargon: Health care reform supporters at the Center for American Progress, the American Prospect, MSNBC and other outlets have deployed the term against Republicans who cite the 10th Amendment as reason not to create new programs. Some of the leading Republican proponents of the allegedly “dangerous” and “conspiratorial” theory include Sens. Tom Coburn of Oklahoma and Jim DeMint of South Carolina, and Rep. Michele Bachmann of Minnesota. “As the nation emerges from the worst economic downturn in three generations, the tenthers would strip away the very reforms and economic

POPSPASS ID Act "is REAL ID 2.0"--Same Federalized Drivers License/National ID Scheme This is like Blackwater changing its name to Xe. No real change, just a new "makeover" to sell it. This tramples the 10th amendment right of the states by pretending that the new federal Dept. of Homeland Tyranny has a right to dictate standards for drivers licenses to the States. It also attacks your 4th amendment privacy, by setting up the same desired data-mining capabilities to watch every 'free American" on demand. RFID included. Tell your Congressmen "no".

POPSGovernors Oppose Federal Martial Law Powers, Invoke States' Rights This could apply to any potential Swine Flu emergency declarations or any other federal responses during acts of terrorism, disasters, or crises whereby the Pentagon has pleaded a domestic role for power. See Clipmark U.S. Military Plans for H1N1 Flu Outbreak Good for the governors and states' rights! As a side, people should note that because Governor's have authority over each states "National Guard" that they could invoke their authority to NOT DEPLOY these troops (never intended for foreign wars) to unjust wars, or war undeclared by Congress (the only lawful wars) for foreign operations, i.e. Iraq, Afghanistan, Pakistan, etc. They have full legal power to resist if only they have political courage to stand upon principle against mistaken notions of zeal or "patriotism" invoked to push such wars. More on that here.

POPSWhy the 10th Amendment movement? "We know, they intend to control our resources, it’s written in the Cap and Trade Bill." "We know, they intend control of our very lives, it’s written in the Health Care Bill." "We know, they intend to control our votes, the 2010 census is now controlled by the white house and the ones registering voters are corrupt" "We watch and wait as they install unaccountable czars for dictating not representing" "We watch and wait as they increase “organizer” funding from millions to billions of our tax dollars. And we wonder how these groups will be used to steal our life, liberty and property from us."

POPSUS Military Plans for H1N1 Flu Outbreak--Martial Law or State's Rights? Major pentagon planning for this new flu. Necessary? And who would decide such? Due to a Bush Executive Order (which Obama did not rescind) just one man, the President (not even Congress, or the States), has the authority to declare National Emergency and Martial Law for either economic or health "crisis" reasons . The Constitutional implications of this preparation have not been debated or discussed, particularly about State's rights. Each state has their own controlled "National Guard", and could decide for themselves, instead of a Federal power-grab over this very controversial issue. However the Federal government believes the MEHPA (Model Emergency Health Powers Act) trumps the 10th amendment. But does it? Not according to the Constitution.

POPSUPDATE: Gov Rick Perry Says Texas May Refuse Obamacare "I think you’ll hear states and governors standing up and saying 'no’ to this type of encroachment on the states with their healthcare," Perry said. "So my hope is that we never have to have that stand-up. But I’m certainly willing and ready for the fight if this administration continues to try to force their very expansive government philosophy down our collective throats."

POPS 62 Million Voiceless Americans
Under the guise of saving the economy, the feds have taken over banks, insurance companies and car companies, prompting even thug dictator Chavez to joke, “Hey, Obama has just nationalized nothing more and nothing less than General Motors. Comrade Obama! Fidel, careful or we are going to end up to his right.” Under the guise of saving us from those nasty capitalists, Obama has appointed a new Pay Czar to make sure no-one is paid more than the politicians deem they are worth. At least those who are unfortunate to work for companies that have received bailout funds. And in one case, the formerly sovereign state of South Carolina has actually been forced to take bailout funds, and accept all the strings that come with it. Consent of the governed is being ignored as the Obama administration hijacks ever more power to the federal government, in direct contravention of the 10th amendment and the Constitution. And 62 million Americans can do nothing except marvel at the audacity.

POPSTennessee Joins 33 States Re-Affirming The 10th Amendment “Be it the federal government mandating changes in order for states to receive federal funds or the federal government telling us how to regulate commerce contained completely within this state – enough is enough,” urged Judiciary Chairman Beavers. "This legislation is being proposed to prevent a federal attempt to legislate beyond the Constitutional limits of Congress. "The Tenth Amendment defines the total scope of federal power as being that which has been delegated by the people to the federal government, and also that which is absolutely necessary to advancing those powers specifically enumerated in the Constitution of the United States. "The amendment was adopted after the Constitutional ratification process to emphasize the fact that the states remained individual and unique sovereignties.

POPSUnconstitutional: Obama Seizes Private Businesses (Update) Think of this for a moment, your private dentist, or doctor, has been treating you for way ten years, along comes that warm fuzzy sounding “”Health Insurance for everyone”, where the Government comes into your dentist’s office, or your Doctor, and tells them, you must now practice out of this facility under this agency or you must stop practicing medicine/Dentistry, thereby forcing the closure of their private business. Its coming folks. The Federal Government is acting in a blatantly unconstitutional manner, and no one seems to be talking about it. The silence in the mainstream Media is nothing short of thundering. The Government is seizing private businesses, and this is just the start. Is this the hope and change you voted for? Government seizing private business? This is not hope. It’s the wanton destruction of the very thing that makes us a free people, the Constitution of the United States. 10th Amendment, 5th Amendment

POPSFederal Government Now Owns the States Your state is now more beholden to the Feds than you because of their money-influence. and the Democratic-controlled Congress, would not jeopardize federal funds but would tell Congress to "get back into their proper constitutional role.” The resolution states the federal government should "cease and desist” mandates that are beyond the scope of its powers. Key said many federal laws violate the 10th Amendment, which says powers not delegated to the U.S. government "are reserved to the states respectively, or to the people.” The Constitution lists about 20 duties required of the U.S. government, he said. Congress should not be providing bailouts to financial institutions and automakers, he said. "We give all this money to all these different entities, including automakers, and now they’re talking about, ‘Well maybe it’s better to let them go bankrupt,’” Key said. "Well, maybe we should have let them go bankrupt before we gave them the money.” To view video click on link: (1:00) http://feeds.newsok.tv/services/player/bcpid4659235001?bctid=22316113001

POPSHomeland Security Wants to Re-Write REAL ID The CNN headline is entirely misleading. Read the clip. They just want better compliance with States and Napolean-itano is bargaining with governors, never mind the 10th amendment and by-passing what citizens think. It will still be a National ID card irregardless of what they name it, even if the original legislation is rescinded. The goal is still the Federalization of a State drivers license , which taps into everyone's Socialist Security Number and biometric data (including facial mapping photos) , therefore linking all financial (bank accounts), medical, legal, and personal credit record by hijacking state drivers licenses for surveillance and data-mining purposes --not to thwart terrorists, but to monitor, track "free Americans" at will, whenever they choose (because you all will comply and consent). This was all based upon 9/11 of course and the typical plea of "necessity" toward a Big Brother Security State.

POPSGov. Rick Perry at the Austin TEA party "In an appearance at the Texas Capitol last week, Perry joined state lawmakers in pushing a resolution that supports states' rights protected in the 10th Amendment to the U.S. Constitution. He said the federal government has become oppressive in its size and interference with states." "After praising veterans in the cheering crowd Wednesday, he said: 'I'm just not real sure you're a bunch of right-wing extremists. But if you are, we're with you.'" "For her part, Hutchison issued a newspaper opinion piece Wednesday criticizing the Democratic-led Congress for spending on the stimulus bill and the $1 trillion appropriations bill." "'On April 15 -- Tax Day -- some in Congress may need a reminder of just who is underwriting this spending: the American taxpayer. I am deeply concerned over the swelling tax burden that will be imposed on all Texas families,' she wrote."

POPSIs Texas a Terror State? It is the opposition of the "overreaching power of the federal government" that seals Texas's fate as a terror state. Rick Perry's statement on the Governor's website supports states' rights under the 10th Amendment. Perry states: "I believe that our federal government has become oppressive in its size, its intrusion into the lives of our citizens, and its interference with the affairs of our state. That is why I am here today to express my unwavering support for efforts all across our country to reaffirm the states' rights affirmed by the Tenth Amendment to the U.S. Constitution. I believe that returning to the letter and spirit of the U.S. Constitution and its essential 10th Amendment will free our state from undue regulations, and ultimately strengthen our Union....Millions of Texans are tired of Washington, DC trying to come down here to tell us how to run Texas." Texas is most definitely a terror state in the eyes of Secretary Napolitano and her agency.

POPSRight Wing Extremists Why were we never warned about the left wing loons that have taken over our country. I am proud to be a "Right Wing Extremist."

POPSSo Tomorrow Is Tea Party Day The combination of the two is scaring the bejabbers out of the left because it has the potential to change the political momentum in the country. So much so that Paul Krugman was dispatched by the New York Times to try and quench it. And the Huffington Post is linking what it calls ‘Tea Bag Terror’ to the rallies I think it is fair to say that the protests have gotten the attention of the left and the right. The question is, will it work? Will an anti-tax rally shift the political debate at a time fewer Americans seem to care about taxes because of Republican success at lowering them? A very interesting article on this from Pollster.com, The Irony of Tax Cuts.

POPSGov. Perry Backs Resolution Affirming Texas' Sovereignty Under 10th Amendment This might have something to do with that report from The Department of Homeland Security written about in the Washington Times this morning. Also Goldman Sachs' plan to repay the US. POPSTexas to ZerObama: Keep your nose out of Texas A number of recent federal proposals are not within the scope of the federal government’s constitutionally designated powers and impede the states’ right to govern themselves. HCR 50 affirms that Texas claims sovereignty under the 10th Amendment over all powers not otherwise granted to the federal government. It also designates that all compulsory federal legislation that requires states to comply under threat of civil or criminal penalties, or that requires states to pass legislation or lose federal funding, be prohibited or repealed.

POPSEnumerated Powers Act "This measure would enforce a constant and ongoing re-examination of the role of our national government," he said. POPSThe 10th Amendment If we are to have a free society for the future, we must reign in this out-of-control federal government, and return to our Constitution; with a special emphasis on the limitations imposed on government by the Tenth Amendment. There are many bills before the States right now that want to re-affirm the 10th Amendment...basically to let the Federal government know that not everyone wants or needs a 'nanny government' to watch over our every move. If you think the 10th Amendment applies, contact your state reps and find out what they are doing to curtail the feds from taking over our lives.

POPSState's Push Resolutions to Stop Federal Intrusion But where were these "Johnny-come-latelies" during the Bush administration--i.e. USA PATRIOT ACT, REAL ID, PATRIOT ACT II, when the tyranny first pushed. Suddenly, when it is politically correct to criticize Bush and a democrat enters the White House, they finally wake up. This is good, but they have a lot of cleaning up to do now to reverse the damage already done. Oklahoma is not alone. Here are the rest of the resolutions from other states: Washington State Declares Sovereignty Arizona New Hampshire Missouri Where is the South, who should be leading this?
