Prosecutors can appeal the ruling. Blackwater contractors had been hired to guard U.S. diplomats in Iraq. The guards said insurgents ambushed them in a traffic circle. Prosecutors said the men unleashed an unprovoked attack on civilians using machine guns and grenades. The shooting led to the unraveling of the North Carolina-based company, which since has replaced its management and changed its name to Xe Services. The five guards are Donald Ball, a former Marine from West Valley City, Utah; Dustin Heard, a former Marine from Knoxville, Tenn.; Evan Liberty, a former Marine from Rochester, N.H.; Nick Slatten, a former Army sergeant from Sparta, Tenn., and Paul Slough, an Army veteran from Keller, Texas.  "Luke Scarmazzo was sentenced to 21 years and 8 months in prison and Ricardo Ruiz Montes got 20 years for operating a marijuana dispensary in Modesto. Sentencing before Federal judge Oliver Wanger took place on November 21, 2008. Luke and Ricardo had a licence to run the dispensary and paid taxes. The conflict between state and federal laws are what led to their arrest and conviction. The case drew attention because of a controversial rap video titled "Business Man" that features a sneering, preening Scarmazzo who raises both middle fingers to the camera and says " the feds." Defense attorneys said the federal government went after Scarmazzo and Montes because the music video challenged law enforcement's authority

  This is the very nightmare scenario I warned about. The courts' steps are outrageous, but predictable and inevitable. A lot of the blame here, however, goes to the administration and the military. They have long taken the position that radical Islamic ideology is not the problem, and that we need only worry about actively those taking up arms against the United States. They don't want us to talk about jihad — the better to keep us in the dark about jihadist ideology. Thus, the government rationalizes, the Uighurs are not a threat to us, only to the Chinese. That was all the daylight the judges need to say: OK, then release them in the U.S., since no other country — except China, where they'd be persecuted — will take them. The government's self-defeating argument is preposterous. Jihadists — and there is not question that the Uighurs are jihadists — do not recognize distinctions based on the Westphalia world of nation-states.

The government suffered a major setback in June when a federal appeals court found the evidence against one Uighur to be so weak that it compared the government's legal theories to a nonsensical 19th-century poem, Lewis Carroll's "The Hunting of the Snark." The court ordered the man, Huzaifa Parhat, released, transferred or offered a new military hearing. The government chose not to retry Parhat and announced it would no longer treat him as an enemy combatant. It subsequently did the same for four others and added the final 12 late last month.
