POPSMandatory Provision of Health Care Bill is Authoritarian, Unconstitutional Both liberals and conservatives are challenging its Constitutionality. To claim to "provide health insurance for thousands of Americans", by simply making it mandatory and threatening a fine (as the Senate bill does) is not a "public service", but tyranny. Listen to this powerful argument, from the left (David Swanson) : The Constitution provides Congress with certain enumerated powers in Article I and explicitly leaves all other powers to the states or the people in the 10th Amendment. So, the constitutional question, for those who still care whether laws are constitutional, is whether the power to force you to buy a horrible product you do not want from a disreputable monopolistic corporation that pays regular bribes to your elected representatives in the form of campaign "contributions" is specifically listed anywhere in Article I. Great point, is it not?

Although the resolutions are not legally binding, Tenth Amendment Center founder Michael Boldin said they “serve notice” that states will no longer automatically enforce federal mandates in areas they believe the central government has no constitutional authority. Montana’s first-in-the-nation law reasserting state authority with the regulation of firearms manufactured and sold within state boundaries was soon followed by a similar law in Tennessee. Officials from the Bureau of Alcohol, Tobacco, Firearms and Explosives have already sent letters to gun dealers and federal permit holders in both states telling them to ignore the state law. A court battle is next. Nearly 20 other states have similar legislation in the works, including directives to their governors to order National Guard troops home from Iraq and Afghanistan. Next year, Arizona will have a state constitutional amendment on the ballot that allows residents to opt out of any national health care program.

It’s higher math, not elementary addition and subtraction. The health care reform fight is not over, of course, since the Senate has yet to act and the balance of power is less favorable there. Still, the House vote gives fresh impetus to the broader movement to bring its weight to bear on Senate deliberations and then on to the reconciliation process where the bill can be improved, including through deletion of toxic elements like the Stupak amendment that would curtail access to abortions.

If the Constitution doesn't expressly give jurisdiction to the federal government over a certain subject, it may not act on it. ....Today, most of us are Subjects of a corrupt government. ... But we are not powerless. We, in fact, should not allow the government to act wrongfully against us....If a law doesn't fit, you must acquit!...We do not need to wait for a ruling from a judge to nix an unjust prosecution. We do not need to wait for the "right" politicians to erect the "right" legislation to take back our inalienable rights. We people are the ultimate check against despotic government authoritarians. Effective use of trial by jury is deadly to government bureaucrats, politicians, and their henchman. It's a highly efficient and bloodless form of rebellion. Shall we take back our Liberty now?

Fundamentally, it’s because the administration’s media war against Fox is but a minor display of the tremendous power the government has to stifle speech it views as illegitimate. Much of this power is the result of long-standing “campaign finance” laws. These laws impose all sorts of restrictions on political speech, and it’s no coincidence that the most draconian of these restrictions are targeted at those who can speak the most effectively against a politician’s reelection. This also means that states have the power to grant licenses to insurance companies, meaning that any new insurance company from its beginnings has to meet state-mandated standards. This is a huge barrier to entry, keeping newcomers out of what would otherwise be a highly competitive market and once again increasing prices for consumers. In a free market, profits are a signal telling more entrepreneurs to enter a market. More and more firms will enter the market until the profits have dropped low enough to discourage market entry. ............ Obama has said that under his current proposal, he would eliminate these state barriers.......... This completely ignores the fact that, under the necessary and proper clause, the government is only allowed to regulate those industries that it must to carry out its stated function.

In other words, with regard to using money to influence presidential candidates, 0.1% of Americans account for 80% of the influence. 2300 energy companies lobbied Congress between 1998 and 2004, with $984 million paid for lobbyists. Why pay a lobbyist $300,000? Because it’s a great investment, of course. Does anyone believe the legal fiction that the purpose of a lobbyist is to educate politicians on the issues? Of course not. Those huge bucks are paid out for skilled middle-men and women to discreetly (or not so discreetly) convey the message that a politician will be handsomely rewarded for screwing over his or her constituents in favor of the lobbyist’s employer.

At least two protesters were injured," it quoted a witness as saying. 12.02pm: Al Jazeera's Alireza Ronaghi, reporting from Tehran, said the security forces were out in force, attempting to keep opposition demonstrators away from Tehran University where Ahmadinejad was speaking earlier. "I didn't expect the protests to be as big," he said Another video appears to confirm that thousands have been involved in the protests today. It also seems to show attempts to prevent filming taking place. 12.57pm: NBC has released more of its interview with Ahmadinejad. In the latest segment, he defended the detention of three Americans, who have been held for more than seven weeks. They "trampled the law, and in accordance with the laws, they need to be punished," he said. The full interview will be broadcast on Sunday.

It was created under the principle of popular sovereignty - that 'We the People of the Several States' created the government, and all powers not delegated to it, were retained." Depending on how you count them, the People delegated approximately 35 powers to the federal government and not included in those powers are national health care, the creation of free speech zones, federal gun regulations, the war on drugs, and more.
