We'll have to have pretrial hearings on the inevitable countless motions about how KSM was apprehended and the evidence against him collected, undoubtedly to the detriment of vital sources of intelligence, like when we lost the ability to track Osama bin Laden by cellphone after our tracing of his calls was revealed by a prosecution under the DOJ Criminal Division then headed by...Eric Holder. And that's even before he starts in on the sob stories about being waterboarded. I'm not seriously concerned that KSM stands any chance of being acquitted, but a hung jury? It only takes one person with extreme political or religious views, one juror who just can't abide the death penalty (even assuming Obama's DOJ pursues it). Just imagine the controversy, if there are Muslims in the jury pool...

 Police initially focused on Mrs Davis and her husband Bart, who were arrested with packed suitcases which included a bloodied pair of trousers. But investigators' attention shifted when Mr Lewis's stolen pistol was traced to John "Monk" Stevenson, a small-time criminal who said he had been given the gun by Bart Davis's brother. He claimed he was only a lookout when Lewis was killed. However, in a plea deal that spared his life, Stevenson – who was also black – changed his story and named the Griffin brothers as the killers and testified against them. According to sworn statements from fellow inmates, Stevenson admitted in jail that the men he implicated knew nothing of the crime. He said that the Griffins "could afford a lawyer and beat the rap". The brothers were the owners of a 138-acre farm, making them probably the wealthiest blacks in the area. All of the land was sold to pay their legal fees and court costs.

Another, Steven Phillips, who spent about 24 years in prison for sexual assault and burglary, will get about $1.9 million. The biggest compensation package will likely go to James Woodard, who spent more than 27 years in prison for a 1980 murder that DNA testing later showed he did not commit. He eventually could receive nearly $2.2 million but first needs a writ from the state's Court of Criminal Appeals or a pardon from the governor. McGowan and the others are among 38 DNA exonerees in Texas, according to the Innocence Project, a New York legal center that specializes in overturning wrongful convictions. Dallas County alone has 21 cases in which a judge overturned guilty verdicts based on DNA evidence, though prosecutors plan to retry one of those.
