POPSSedition Act of 1918 U.S. citizens, including members of the Industrial Workers of the World union, were also imprisoned during World War I for their anti-war dissent under the provisions of the Sedition Act. Anti-war protesters were arrested by the hundreds as speaking out against the draft and the war became illegal under this law.

POPSCalif. Lawyer Who Challenged Obama Citizenship Fined $20,000
For those of you who haven't had the pleasure of watching one of her press conferences, then you can't truly appreciate the "train wreck" that is Orly Taitz, Attorney-at-Law. Ms. Taitz is a leader in the so-called "Birther Movement," the movement that challenges President Obama's right to hold office on the grounds that he is not a U.S. citizen. The ABA Journal Law News Now reports that a federal judge in Georgia fined Taitz $20,000 for her wild accusations in court and ordered her not to pursue any further frivolous actions in court - ever. In my opinion, this should render Taitz unable to practice law. Not to be dissuaded, Taitz filed a motion for reconsideration the next day. This motion was apparently denied, the judge writing, “Counsel’s wild accusations may be protected by the First Amendment when she makes them on her blog or in her press conferences, but the federal courts are reserved for hearing genuine legal disputes, not as a platform for political rhetoric and

POPSOur Constitution is on Life Support Intentionally lost in all this noise is the Leftist tactic of drowning its opposition in waves of excessive and ever-changing health care minutia. With the devil being so well hidden in the details, this ensures that we remain distracted while Rule of Law is further usurped by the rule of man. Sadly, not one Democrat bill addresses "health care" so much as it seeks omnipotent centralized government power and control, the currency of the Left. However, the proposals certainly betray the Left's condescension and contempt for Rule of Law, along with their frontal assault upon our Essential Liberty.

POPSA Guide to Understanding the Tactics of the Southern Poverty Law Center in the Immigration Debate It is therefore essential that we thoroughly examine and respond to the charges and the motives of those leveling the accusations. This publication is designed for the media, legislators and others who are actively involved in writing about or formulating immigration policy. Its purpose is to provide: * An overview of the unscrupulous tactics now being used in the immigration debate which distort factual reporting and limit meaningful debate. * A summary of FAIR’s 30-year record of advocacy on immigration. * An examination into the SPLC’s motives, terminology and techniques used against FAIR and others. * An objective third party analysis of the SPLC’s tactics and motivations. * Conclusions and suggestions for fair reporting and open mindedness.

POPSFt. Hood suspect reportedly shouted `Allahu Akbar' At least six months ago, Hasan came to the attention of law enforcement officials because of Internet postings about suicide bombings and other threats, including posts that equated suicide bombers to soldiers who throw themselves on a grenade to save the lives of their comrades. Investigators had not determined for certain whether Hasan was the author of the posting, and a formal investigation had not been opened before the shooting, said law enforcement officials who spoke on condition of anonymity because they are not authorized to discuss the case. The FBI, local police and other agencies searched Hasan's apartment Thursday night after evacuating the complex in Killeen, said city spokeswoman Hilary Shine. She referred questions about what was found to the FBI. The FBI in Dallas referred questions to a spokesman who was not immediately available early Friday morning.

POPSPro-Pot - Anti-Gay Election Results
Yesterday in the state of Maine there were "pro-pot," and "anti-gay," referendums on the ballot. Results: Pot, yea; Gay, No. But...maybe that exaggerates the results. It wasn't like the people of Maine voted to pass out marijuana at the schools (they formalized a distribution method) and it wasn't like the voters of Maine wanted to start gay folks witch hunts (they didn't want to approve state "marriage status," to gays). There are lots of ways of looking at these political decisions. Should gay rights even be an item up for vote or a right protected by the Constitution? But is gay marriage a gay right? Maine is now the 31st state to have a direct referendum on gay marriage and they have all turned it down. Maine is now the 5th state to allow the "medical," use of marijuana. With Obama telling the Feds not to prosecute individual users acting in accord with their state's laws, I'd expect a lot more states to go this way. No knighthoods being given out, in either cas

POPSEmergency! Congress Debates Burying the Goldstone Report! "TELL CONGRESS TO RESPECT US AND INTERNATIONAL LAW!" "What message are we sending to the rest of the world when we grant Israel complete impunity? This legislation has very important implications beyond the war crimes committed in Gaza. Israel has responded to the report by demanding the Western powers rewrite international and US law, warning that acceptance of the Goldstone report will mean that the US’ military campaigns in Iraq, Afghanistan and Pakistan will be subject to similar scrutiny. (Judge Goldstone has drawn a distinction – stating that his report finds that Israel deliberately targeted civilians). This legislation also ignores serious allegations that Israel has violated the US Arms Export Control Act."

POPSMaine Puritans Deny Rights The Religious Right is alive and well in Maine. At least for 53% of the population. Distaste for anyone who doesn't share their sexual inclinations combined with a healthy dose of religiously fueled hate mongering have combined to deny rights to the LBGT community in Maine. Congratulations citizens of Maine. You've won in your quest to deny basic rights to a sizable portion of your population and should be proud that you've turned them into second class citizens.

POPSNoor Almaleki is Dead :( :( Let's pray Rifqa Bary isn't next. Btw: I met Pam Geller, Robert Spencer and a whole wack of other awesome folks at the International Legal Conference of Free Speech and Religion last week in Washington Dc. It was a real honor. You can hear much more about the conference at : http://gatesofvienna.blogspot.com/2009/11/legal-conference-on-freedom-of-speech.html#readfurther (and on a much needed lighter note, I had the good fortune to run into Steven Crowder at Dulles Airport last night and got to thank him for his work---he was exactly like he is in the videos---good guy )

POPSObama, Maurice Strong, Al Gore Key Players Cashing In.... continued
the man who was to become President of the United States of America. If we follow the time line on where Obama was during the funding of the Chicago Climate Exchange, he was still a professor at the University of Chicago Law School teaching constitutional law, with his law license becoming inactive a year later in 2002. It may be interesting to note that the Chicago Climate Exchange in spite of its hype, is a veritable rat’s nest of cronyism. The largest shareholder in the Exchange is Goldman Sachs. Chicago Mayor Richard M. Daley is its honorary chairman, The Joyce Foundation, which funded the Exchange also funded money for John Ayers’ Chicago School Initiatives. John is the brother of William Ayers. What a flap when it was discovered that the senator from Chicago had nursed on Saul Alinsky’s milk, had his political career launched at a coffee party held by domestic terrorist Bill Ayers, and sat for 20 years, uncomplaining in front of the

POPSTroubling Signals on Free Speech The ambiguously worded United Nations Human Rights Council resolution could plausibly be read as encouraging or even obliging the U.S. to make it a crime to engage in hate speech, or, perhaps, in mere "negative racial and religious stereotyping." This despite decades of First Amendment case law protecting such speech. To be sure, the provisions to which I refer were a compromise, stopping short of the flat ban on defamation of religion sought by Islamic nations, and they could also be construed more narrowly and innocuously. It all depends on who does the construing. Is it "negative stereotyping" to say that the world's most dangerous terrorists are Islamists, for example? Many would say yes. more at source

POPSThe coat of arms of Switzerland is protected by American law? WTF? Perhaps someone with more legal background than I could lend their experience to me and answer WHY the Swiss coat of Arms is protected under US Law? And carries with its misuse the same Punishment. It just doesn't make any sense and either I'm tried and somehow keep missing it or its a pain to find. Just curious is all, I like mysteries but this is beginning to bug me after a few days or so (on & off) Over to you guys. (I Hope)

POPSCrazy Sheriff Joe Arpaio facing FBI investigation for abusing his power by arresting his critics We described Arpaio's incredible thuggery late last year in his dealings with the public, especially those who dare criticize him. An anti-Arpaio group called Maricopa Citizens for Safety Accountability, which formed last year in response to investigative reports and studies demonstrating that Arpaio's insane obsession with illegal immigrants was destroying his office's ability to actually deal with real law enforcement work, began showing up at county board meetings and asking to speak. Arpaio actually sent out his deputies in force to patrol these meetings, and they arrested people for merely applauding Arpaio's critics. If that sounds fascist to you, that's about right -- after all, some of the local neo-Nazis are Arpaio's biggest fans -- and he's been known to return the love.

POPSUS Planning to Weaken Copenhagen Climate Deal The move reflects a "prehistoric" level of debate on climate change in the wider US, according to another high-ranking European official, and anxiety in the Obama administration about its ability to get a new global treaty ratified in the US Senate, where it would require a two-thirds majority vote. The US has not ratified a major international environment treaty since 1992 and President Clinton never submitted the Kyoto protocol for approval, after a unaminous Senate vote indicated it would be rejected on economic grounds. Stuart Eizenstat, who negotiated Kyoto for the US, said: "There has been a sea change in US attitudes and the new president is deeply committed on this issue. But the EU needs to understand the limitations in the US. The reality is that is it impossible for my successor to negotiate something in Copenhagen beyond that which Congress will give the administration in domestic cap-and-trade legislation."

POPSProtect against toxic chemicals
I am shocked and deeply disturbed that the law that is supposed to protect Americans from exposure to toxic chemicals is so outdated that China is allowed to export toxic materials into the United States that are not only banned in Japan and Europe, but can't even be used domestically in China. Every American alive today, including newborn babies, has hundreds of chemicals flowing through their blood. Many of these chemicals are linked to prostate and breast cancers, diabetes, heart disease, lowered sperm counts, early puberty and other diseases and disorders. Yet, of the 82,000 chemicals available for use in the U.S., only about 200 have been required to be tested for safety. And the EPA has succeeded in banning only one group of chemicals, PCBs, from the marketplace. It's time to reform the Toxic Substances Control Act (TSCA). I urge you to support legislation that will: view more 1. Take immediate action to stop the use of the most dangerous toxic chemicals; 2. Give

POPSObama Girls Spared Maoist Vaccination Indoctrination Wow. That’s a pretty loaded blog title. Maoist indoctrination? Hmmm. Well, I don’t buy into it being an excuse to declare martial law and enslave the white race. That’s a bit of a stretch. Engineered plague? Only if you buy into the martial law and enslavement thing, yeah I can see you believing this one too. But what really bites me is this swine flu vaccination is being shoved down our throat, and up our noses, under the guise of a national emergency while not nearly as many people have died from H1N1 as have those who get the regular flu every year and the Obama kids are not even going to be vaccinated. What’s up with that Mr. and Mrs. Obama? A money making scam for Big Pharma? Now this is a conspiracy I can sink my teeth into.

POPSSigning Away Our Sovereignty
We should be aware that Obama intends to roll out for Senate approval a series of international treaties that will further bind America to the will of the international community if they are ratified. Bit by bit, America's autonomous power is being taken away. The Boston Globe provides a public relations gloss by calling these treaties a means of fulfilling "Obama's vision of global cooperation." This is one view, I suppose. Another view would be that our policies will be tied down by these treaties -- and we will be judged by international bureaucrats and held to their interpretation of what our obligations are under the treaties. International treaties require only Senate approval. Obama will begin with treaties designed to achieve his vision of a world without nuclear weapons. But that is just the beginning. Efforts will begin to bind America to the U.N. Convention on the Law of the Sea....This will hurt our nation's ability to mine the world's seas for oil and gas....

POPS Obama's Disdain for Constitution That's why they are "so-called Founders" to him. Here is Thomas Jefferson's first inaugural address, March 4th, 1801: "A wise and frugal government which shall restrain men from injuring one another, which shall leave them otherwise free to regulate their own pursuits of industry and improvement, and shall not take from the mouth of labor the bread it has earned. This is the sum of good government." Thomas Jefferson, "so-called Founder." Thomas Jefferson: "Congress has not unlimited powers to provide for the general welfare, but only those specifically enumerated." So-called Founder. John Adams, A Defense of the Constitutions of Governments of the United States of America, 1787: "The moment the idea is admitted into society that property is not as sacred as the law of God, and that there is not a force of law and public justice to protect it, anarchy and tyranny commence."
