When the Congressional Budget Office considered the idea of a health insurance mandate back in 1994 under the Clinton administration, it concluded that the mandate would be "an unprecedented form of federal action." The only congressional mandate close to that was the draft, the CBO concluded. Other legal objections are emerging in the wake of a concession that Sen. Ben Nelson, D-Neb., won for his state as a condition for his support of the health care bill. Senate Majority Leader Harry Reid agreed to provide for full and permanent federal aid for Nebraska's expanded Medicaid population. It was only one of a slew of hand-crafted sweetheart deals for those senators who agreed to support the bill. Graham said his state could file an equal rights suit under the Constitution. I’ve spoken about the other side of this before. Both the House and Senate versions of the health care bill create insurance exchanges that all Americans must by their health care through. The government controls what insurance plans are offered on those exchanges. Now, per this part of the bill, your insurance company can only pay out to health care providers who meet the government’s standards for providing care. Meaning, for instance, that if the government should decide to stop covering mammograms for women younger than 50 then you won’t be able to buy a plan which covers that, or go to a hospital which gives such screenings. The same goes for all sorts of treatments, drugs, medical devices, etc. If it isn’t government approved, you won’t get it.

Although the resolutions are not legally binding, Tenth Amendment Center founder Michael Boldin said they “serve notice” that states will no longer automatically enforce federal mandates in areas they believe the central government has no constitutional authority. Montana’s first-in-the-nation law reasserting state authority with the regulation of firearms manufactured and sold within state boundaries was soon followed by a similar law in Tennessee. Officials from the Bureau of Alcohol, Tobacco, Firearms and Explosives have already sent letters to gun dealers and federal permit holders in both states telling them to ignore the state law. A court battle is next. Nearly 20 other states have similar legislation in the works, including directives to their governors to order National Guard troops home from Iraq and Afghanistan. Next year, Arizona will have a state constitutional amendment on the ballot that allows residents to opt out of any national health care program.

Here's what an anonymous senior administration official told Congress, speaking through the New York Times: "If you don't pass this legislation, then ... the EPA is going to have to regulate in this area," the official said. "And it is not going to be able to regulate on a market-based way, so it's going to have to regulate in a command-and-control way, which will probably generate even more uncertainty."

POPS Obama Banking Bill Passed by US House mortgages of financially struggling borrowers was defeated. David Hirschmann, a director of the US Chamber of Commerce, said: “While there is a laundry list of bad choices that were made by the House, the creation of the CFPA tops the list.” However, he said he was encouraged by the “growing group of moderate Democrats” who helped amend the bill to prevent states from setting tougher consumer protection standards. Another provision that has been resisted by banks allows regulators to impose a loss on creditors of failing financial institutions that need to be seized by the government. After stark warnings that the provision would make credit less liquid and more expensive, the size of the “haircut” to be imposed on creditors was reduced to up to 10 per cent and some securities were exempted. POPSEPA Rules Farm Dust NOT SAFE, Must Be Regulated But the U.S. District Court of Appeals in Washington ruled Tuesday that the EPA had already provided the evidence necessary to determine farm dust "likely is not safe." Michael Formica, a lawyer for the pork council, said this means farmers now face the daunting task of proving a negative - that the dust is not harmful. Formica said his and other groups will consider a further appeal. Farmers said they will be hard-pressed to meet the standards. In a letter sent Wednesday to the EPA, Grassley wrote that compliance would be impossible because of the dust produced in farmers' day-to-day activities. Grassley also has noted that because many rural roads are not paved, particulate readings could be affected by wind gusts that constantly change. Half of the Doctors I have talked too are not even recommending for their patients and certainly our pediatricians are saying not to get the H1N1 for our kids, which we had not planned to do anyway. If I was these doctors and nurses I would just not get it as the state is just asking for a huge shortage of nurses and docs by doing this. Society needs the nurses and docs, they don't necessarily need to stay at these jobs.
