Just as the Republican minority in the Senate has stalled the current health care debate, a Democratic minority could do the same to any repeal measure unless Republicans were able to pull together at least a 60-vote majority. The GOP would also have to overcome the strong majority Democrats now have in the House. Even if they were to win both chambers back, President Obama could veto any repeal measure at least through 2012. "Anyone who thinks they'll be able to repeal ObamaCare is kidding themselves," Michael Cannon, director of health policy studies at the libertarian Cato Institute, told the Washington Independent. "If they want to stop it, they need to stop it now."

The non-profit Fund for Personal Liberty, as well as a Virginia-based group called the 10th Amendment Foundation, already have threatened to file suit in federal court over this issue if the health care bill passes. The Constitution allows Congress to tax, borrow, spend, declare war, raise an army and regulate commerce, among other things. Proponents of the insurance mandate point to the Commerce Clause in arguing that Congress is within its rights to require health insurance and dismiss such potential legal challenges. But foes say the across-the-board requirement is too broad.

POPSSOMEONE NEEDS A TELEPROMPTER!!! I approached (AUDIO) Senator Whitehouse following his speech on the floor, and his responses to my questions were puzzling, to say the say the least. Mr. Whitehouse said he stood by his speech, but would not admit that he was accusing anyone who was against the health care bill as racist. He did reiterate that birthers are part of the group that is against the bill and are attacking president However, when I asked the Senator from Rhode Island what he meant by describing those who do not support the bill as "aryan," he responded "No, I didn't say that....again, pay attention to the speech." According to the transcript above, Mr. Whitehouse did say what he seems to be denying. Perhaps he should pay more attention to what he says on the floor.

POPSDirty Harry Reid’s "ABORTION FIX" IS NOT FIXED ~ “Manager’s Amendment" that cover elective abortions. The new language does include a “state opt-out” provision if a state passes a law to prohibit insurance coverage of abortion, but it’s a sham because it does nothing to prevent one state’s tax dollars from paying for elective abortions in other states. A majority of Americans believe that health care plans should not be mandated to provide elective abortion coverage, and a majority of Americans do not believe government health care plans should include abortion coverage. Currently, federal appropriations bills include language known as the Hyde Amendment that prohibits the use of federal funds to pay for elective abortions under the Medicare and Medicaid programs, while another provision, known as the Smith Amendment, prohibits federal funding of abortion under the federal employees’ health benefits plan .

Sure, the company has some serious problems, and its liquidity crisis of 2008 will remain one of the worst business disasters of all time. But since then, AIG has somehow morphed from a deeply troubled company into an avatar of all things wrong with the corporate world. And while I won’t suggest we forget (or even forgive) AIG of the policies and actions that nearly tanked the world economy, we must resist the urge to make this company into things that it is not. Villainization, while it may make us feel good, usually distracts us from the complexities of a situation we must somehow address. It’s easy to say that any given problem came about because somebody — that guy! over there! — was a greedy jerk. It’s far more difficult to see problems in a wider context, to understand how those problems came about, to address those problems on their own terms, and to take meaningful action to try to prevent those problems from arising again. POPS20 GOP Senators Call for Investigation of Offutt Threat Let’s be clear: the people spreading these falsehoods think nothing is wrong with a system under which families and businesses continue to bear the brunt of skyrocketing costs, insurance companies are allowed to discriminate and drop at will, and thousands of Americans lose their coverage every single day.” They protest a little too much. I do not know this story is "absolutely false." To the contrary, I'm confident it's true. Twenty senators are now calling for an investigation, and each is presumably pretty well sourced in the Senate. If the charges are "absolutely false," maybe the White House will encourage Senate Democrats to call this Republican bluff. I won't hold my breath. What is absolutely true is that the threat itself is clumsy. The Base Realignment and Closure Process won't get started again for a couple of years, and Offutt is a nearly irreplaceable piece of America's national security infrastructure.

POPSFight On! Leaves Him No Choice But To Win in Afghanistan Well, for starters because it’s considered Dem accompli … not least by the GOP. There’s an element of cold harsh reality in that. This is an electorate that remained largely asleep and disinterested when lawmakers, taking their cue from the 70-30 vote against a ballot measure to phase out the income tax, raised taxes. I would have thought the GOP would be more interested in kicking off the 2010 election season with a good showing, if not a win, in bluest Mass. Those are sheep guts that all the soothsayers would want a look at.
