As I wrote when the first stimulus package was announced, and other well-known entities have since picked up on it, it was created and is now being used as, yet, another Marxist-Democrat slush fund. 2. The non-profit Fund for Personal Liberty, as well as a Virginia-based group called the 10th Amendment Foundation, already have threatened to file suit in federal court over this issue if the health care bill passes. The Constitution allows Congress to tax, borrow, spend, declare war, raise an army and regulate commerce, among other things. Proponents of the insurance mandate point to the Commerce Clause in arguing that Congress is within its rights to require health insurance and dismiss such potential legal challenges. But foes say the across-the-board requirement is too broad.

The Democrat majority just voted to retain the culture of corruption in Congress. Just two years ago, Democrats bragged about draining the swamp, but now they’re endorsing political bribery. This is Washington at its worst.” Senator Ben Nelson (D-Nebraska), who secured a special earmark for his state that forces taxpayers in 49 states to fund Medicaid in Nebraska, first voted against the ban on trading earmarks for votes but switched his vote before the final tally. Senator DeMint responded, “Senator Nelson, unfortunately, is trying to have it both ways, he was for trading his vote for earmarks before he was against it."

POPS The Health Care Sortie The CBO’s letter shows that cuts to the budget will have to result in cuts to the system and benefits if Congress intends on using the money to pay for other efforts. The second argument to die on this report is the supposed deficit neutrality of Obama Care…. Stupak is still being a problem about abortion spending . However, the Stupak coalition is already seeing what is happening to Judas Ben Nelson. This likely will harden their position on holding to their pro-life principles because they don’t want to reap the whirlwind that Nelson is.

POPSReid Bill Says Future Congresses Cannot Repeal Parts of Reid Bill
i'm not even sure that it's constitutional, but if it is, it most certainly is a senate rule. i don't see why the majority party wouldn't put this in every bill. if you like your law, you most certainly would want it to have force for future senates. i mean, we want to bind future congresses. this goes to the fundamental purpose of senate rules: to prevent a tyrannical majority from trampling the rights of the minority or of future congresses. According to page 1001 of the Reid bill, the purpose of the Independent Medical Advisory Board is to "reduce the per capita rate of growth in Medicare spending." For any fearmongers out there tempted to call an unelected body that recommends Medicare cuts a "Death Panel," let me be clear. According to page 1004, IMAB proposals "shall not include any recommendation to ration health care"--you know, just like the bill says there's no funding for abortion. Paging Sarah Palin: the death panel is unkillable.

Although the resolutions are not legally binding, Tenth Amendment Center founder Michael Boldin said they “serve notice” that states will no longer automatically enforce federal mandates in areas they believe the central government has no constitutional authority. Montana’s first-in-the-nation law reasserting state authority with the regulation of firearms manufactured and sold within state boundaries was soon followed by a similar law in Tennessee. Officials from the Bureau of Alcohol, Tobacco, Firearms and Explosives have already sent letters to gun dealers and federal permit holders in both states telling them to ignore the state law. A court battle is next. Nearly 20 other states have similar legislation in the works, including directives to their governors to order National Guard troops home from Iraq and Afghanistan. Next year, Arizona will have a state constitutional amendment on the ballot that allows residents to opt out of any national health care program.

Democrats today voted to cut nearly half a trillion dollars from Medicare. The AP reported: Casting its first votes on revamping the nation’s health care system, the Senate rejected a Republican bid Thursday to stave off Medicare cuts and approved safeguards for coverage of mammograms and other preventive tests for women. The first round of votes ended with a fragile Democratic coalition hanging together. Senators voted 58-42 to reject an amendment by Sen. John McCain, R-Ariz., that would have stripped more than $400 billion in Medicare cuts from the nearly $1 trillion measure. It would have sent the entire 2,074-page bill back to the Senate Finance Committee for a redo. Republicans said the proposed cuts to health insurance plans and medical providers mean seniors in the popular Medicare Advantage program will lose benefits. And they predicted lawmakers will ultimately back away from the cuts, once seniors start feeling the brunt.

For those of you who haven't had the pleasure of watching one of her press conferences, then you can't truly appreciate the "train wreck" that is Orly Taitz, Attorney-at-Law. Ms. Taitz is a leader in the so-called "Birther Movement," the movement that challenges President Obama's right to hold office on the grounds that he is not a U.S. citizen. The ABA Journal Law News Now reports that a federal judge in Georgia fined Taitz $20,000 for her wild accusations in court and ordered her not to pursue any further frivolous actions in court - ever. In my opinion, this should render Taitz unable to practice law. Not to be dissuaded, Taitz filed a motion for reconsideration the next day. This motion was apparently denied, the judge writing, “Counsel’s wild accusations may be protected by the First Amendment when she makes them on her blog or in her press conferences, but the federal courts are reserved for hearing genuine legal disputes, not as a platform for political rhetoric and

POPSTroubling Signals on Free Speech The ambiguously worded United Nations Human Rights Council resolution could plausibly be read as encouraging or even obliging the U.S. to make it a crime to engage in hate speech, or, perhaps, in mere "negative racial and religious stereotyping." This despite decades of First Amendment case law protecting such speech. To be sure, the provisions to which I refer were a compromise, stopping short of the flat ban on defamation of religion sought by Islamic nations, and they could also be construed more narrowly and innocuously. It all depends on who does the construing. Is it "negative stereotyping" to say that the world's most dangerous terrorists are Islamists, for example? Many would say yes. more at source
