 Every single Democrat in the current majority, including Barack Obama, swore an oath to "preserve, protect and defend" the Constitution. Yet, they absolutely ignore the limitation of power set forth in Article 1, Section 8 of the Constitution. None of the 17 powers enumerated there authorizes the current health-care bills or the cap-and-trade bill, or the bailout, or the stimulus package – all recently passed by the House of Representatives. When asked by a reporter to identify the constitutional authority for the current health-care bills, Sen. Patrick Leahy said: "We have plenty of authority, why would you say we don't have authority?" Speaker Nancy Pelosi's reply to the same question was: "Are you serious? Are you serious?" Obviously, neither one is "preserving, protecting or defending" the Constitution when they ignore its limitation of congressional power.

They have to specifically point in the Constitution where they get the authority. And as a matter of fact the reason the Enumerated Powers Act’s maximum number of co-sponsors in the House has been 31, or it could be a bit higher than that (and it has never had a co-sponsor in the Senate until this year) is that the Congressmen can read the writing on the wall. If Congress were forced to obey the United States Constitution, then I would say that two-thirds to three-quarters of all the spending Congress does would be found to be unconstitutional. ALL RIGHT MAGAZINE: You’re probably right about that. Article 1, Section 8 has a very short list of things government is able to do according to the word of the law. WALTER E. WILLIAMS: That’s right, and if you read the Founders’ statements, they say that Congress can only do those things....

 Yesterday in the state of Maine there were "pro-pot," and "anti-gay," referendums on the ballot. Results: Pot, yea; Gay, No. But...maybe that exaggerates the results. It wasn't like the people of Maine voted to pass out marijuana at the schools (they formalized a distribution method) and it wasn't like the voters of Maine wanted to start gay folks witch hunts (they didn't want to approve state "marriage status," to gays). There are lots of ways of looking at these political decisions. Should gay rights even be an item up for vote or a right protected by the Constitution? But is gay marriage a gay right? Maine is now the 31st state to have a direct referendum on gay marriage and they have all turned it down. Maine is now the 5th state to allow the "medical," use of marijuana. With Obama telling the Feds not to prosecute individual users acting in accord with their state's laws, I'd expect a lot more states to go this way. No knighthoods being given out, in either cas

Wars for democracy are a key element of both parties now. There is an insidious philosophy underlying this acceptance of the "natural" growth of statism.  News flash for Congressman Hoyer: "general welfare" is mentioned only twice in the Constitution. The phrase appears once in the Preamble, but the Preamble gives the legislative branch no authority whatsoever. "General welfare" is also mentioned once in Article I, Section 8. Here is what it actually means in that section. The powers of the legislative branch are stated in the Constitution. The powers specifically granted to the Congress are spelled out in Article I, Section 8. Since it isn't that long of a section -- and there aren't that many powers -- I will reproduce the entire enumerated powers of the Congress in the first endnote below . The words "general Welfare" show up in the first line of Article I, Section 8: The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States ... He has claimed that it is an unconstitutional *" Bill of Attainder " an argument that has been thoroughly rebutted by former FEC Commissioner Hans von Spakovsky. Nadler had no such reservations when he co-sponsered legislation to punish AIG employees who had been awarded bonuses. *A legislative act pronouncing a person guilty of a crime, usually treason, without trial and subjecting that person to capital punishment and attainder. Such acts are prohibited by the U.S. Constitution. Congress moving to cut off funds to ACORN for the next 50 days is a merely a first step. An organization with ACORN’s history of voter registration fraud, tax evasion, and criminal activity should never again be eligible to receive any federal funds. Stopping payment to this criminal enterprise is not enough.

 Thus, by virtue of his election to the presidency nearly one year ago, he believes he has the authority to establish a new paradigm to "fundamentally transform" our nation by creating "a new foundation." However, if we are a nation of laws with a national government limited by our Constitution, and, indeed, we are, then Obama has no legal authority to "transform" our government. Those who laid our constitutional foundation were very clear about its limits on government. Our Constitution's principle author, James Madison, wrote, "The powers delegated by the proposed Constitution to the federal government are few and defined will be exercised principally on external objects, as war, peace, negotiation and foreign commerce."
