That is precisely the kind of open-ended grant of regulatory power that effectively establishes the IMAB as the ultimate arbiter of the cost, quality and quantity of health care to be made available to the American people. And Reid wants the decisions of this group of unelected federal bureaucrats to be untouchable for all time.

POPS“Death Panels”Regulations: Senate Requires Super-Majority to Repeal 
To change the rules of the Senate, there must be sixty-seven votes. Section 3403 of Senator Harry Reid’s amendment requires that “it shall not be in order in the Senate or the House of Representatives to consider any bill, resolution, amendment, or conference report that would repeal or otherwise change this subsection.” The good news is that this only applies to one section of the Obamacare legislation. The bad news is that it applies to regulations imposed on doctors and patients by the Independent Medicare Advisory Boards a/k/a the Death Panels. Section 3403 of Senator Reid’s legislation also states, “Notwithstanding rule XV of the Standing Rules of the Senate, a committee amendment described in subparagraph (A) may include matter not within the jurisdiction of the Committee on Finance if that matter is relevant to a proposal contained in the bill submitted under subsection (c)(3).” In short, it sets up a rule to ignore another Senate rule.

POPSDo you trust Harry Reid? This section of the bill sounds like it is taking away the power of future congressional leaders to change the healthcare bill. I don't care if there are death panels or not, placing restrictions on future legislative action seems short sighted and scary to me.

He conceded that no more specific deal – much less a legally binding one – was possible until the issue of “trust” between industrialized and developing nations was resolved. The agreement contained none of the specific emissions targets European and African negotiators had hoped to nail down, simply a broad-brush promise by the countries in the room to cap the overall global temperature rise to two degrees Celsius and provide a written record of their planned reductions. It’s unclear how many nations, particularly poorer countries who felt shut out of the process, were included in the final deal or how they will vote if the deal is put to one.

I'm sure there are other things in it that are unconstitutional as well and I wondered why no one had mentioned the SC. I guess they were waiting until the final bill was composed; but why waste time when there's some obvious problems and after all....Congress is in such a hurry!
