The other company that has the 'similar' trademark is Android Data, that was formed sometime ago and has not produced a product since 2003. Data's trademark was up for renewal due to it expiring and it was just renewed - at the end of the six month grace period. The two products are dissimilar and should not be an issue when it comes to the appeal: one is a mobile operating system by Google and the other is a non-existent product. Android Data has not and does not produce a competing product that a consumer would directly be confused by if both were in the market. |
