 <TABLE cellspacing="0" class="left"><TBODY><TR><TD><LABEL><A href="http://tw.news.yahoo.com/photo/url/d/i/071224/78/20071224_1165251/20071224_1165251.jpg.html" title=""><IMG src="http://l.yimg.com/tw.image.news.yahoo.com//xp/libertytimes/20071224/04/3296475393.jpg" /></A></LABEL></TD></TR></TBODY></TABLE><P>〔記者陳曉宜／台北報導〕拚績效拚過頭？蔡姓<A title="大學" class="ynwsyq yqclass" href="?" id="yui-gen0"><SPAN>大學</SPAN></A>生在<A title="部落格" class="ynwsyq yqclass" href="?" id="yui-gen1"><SPAN>部落格</SPAN></A>抱怨學生拍片缺錢，開玩笑要有錢人包養，不料被警方移送法辦，檢察官調查後認定蔡生純屬開玩笑，獲不起訴處分。立委林郁方昨天痛批警方為績效小題大作，刑事局強調是依法移送，有無犯罪意圖須交由檢方及法院認定。</P><P>蔡生昨天由林郁方陪同舉行記者會。蔡生表示，為凸顯學生獨立製片的艱辛，今年6月，他在自己的部落格中寫著「為了拍攝自己第一部影片，已經花了快4萬元，原來這就是學生製片的痛苦，誰是有錢人？快來快來，不論一百一千一萬，快來包養我吧。I need y ~~~」的文章，之後一位同學留言說：「好啦！我1塊包養你。」連他親姊姊都上網留言說：「姊養你啦！」</P><P>蔡生說，他在2天之內就留言說：「終於感受患難見真情，哈哈哈，我是開玩笑的啦！」沒想到，警方突然在8月時打電話告訴已觸法，他在電話中向警方表明是開玩笑的，但警方還是叫他到警局作筆錄，並被移送法辦。</P><P>林郁方表示，警方在電話中還謊稱該案已經移送，叫他到警局作筆錄，事實上是要取得蔡生的自白作為證據，無範圍、無標準且牽涉誤用法條，已形成文字獄，他將要求<A title="警政署" class="ynwsyq yqclass" href="?" id="yui-gen2"><SPAN>警政署</SPAN></A>重新檢討辦案方式。</P><P>刑事警察局預防科組長韋愛梅則解釋表示，網路援交、賣淫經常使用同音字或暗示用語，例如「月援人團援」等，但警方對於是否開玩笑並無裁量權，只要符合犯罪構成要件就必須移送。</P><P></p> </DIV>
