Difference is that Japan signed agreements outlining the treatment of soldiers during war and the Taliban/Al Qaida are not recognized as a government, did not sign and do not have standing. Yet. Our new government will concede and give it to them.

Meanwhile, beheading of journalists is apparently ok as long as when we capture terrorists we don't intimidate by caterpillars or sleep deprivation.
