This also presents the possibility of him getting off on a legal technicality.

An outrage! I think a lot of people, above all the families of the victims of 911 will not tolerate that trial being held in NY..

Amazing how right wingers are once again going ballistic over this.

This shows either one of two things:

1. They don't have any faith in the American civilian court system to produce a fair trial, or

2. They don't want the trial to be fair. In which case their support for the whole concept of a fair judicial system is suspect in the first place.

I suspect the second alternative: Right wingers have no deep seated belief in either democracy or a fair and just legal system. Fascism, with it's flag-and-Bible waving and military show trials will go down much better with them.

Problem 1. Some of the judges in the American civilian court system were placed there for political reasons because they would produce rulings that would be acceptable for lefties, or tow the liberal line. There is a chance that the judge for this trial will be one of those judges with an axe to grind and who will let this guy off the hook. Then he can begin to plot the next 9/11 type of attack.

Problem 2. The judge and or jury may feel intimidated by the prospect of condemning an important al qaeda terrorist. They'll know that they may have to fear for their lives, for the rest of their lives, and so they may feel pressured to let the guy off the hook. No such problem...

Problem 4. This court case could drag out over the course of many months. During this time New York will be a major al qaeda target because that's where the trial is being held. The people of New York will be in greater danger because of the presence of the trial.

Apart from flawed counting abilities - how do you get from problem 2 to problem 4 directly? - your arguments are flawed as well.

The judge could just as well be a raving right wing lunatic. That is what you get with political appointments - debasement of the legal system.

A military kangaroo court is something that should not even exist in the first place, so I won't waste my time discussing that possibility.

aperiozar: You were a little quick to insult my intelligence. I didn't skip problem 3, you have to click the "read more" link near the bottom of the comment to read it the third problem.

Even a "right wing lunatic" would likely not free the terrorist mastermind of 9/11 for political reasons. So I think my argument is still valid in that regard.

"kangaroo" court? I'm not certain what you base that assessment on. My entire argument describes the very reasons the military court should exist. If you disagree, please explain why.

You entirely ignored the other points I made regarding the danger in having the trial in New York. Do you feel those risks are acceptable, or disagree that the risks exist?
