這是國內第一件認定P2P網路平台侵害著作權有罪的刑事判決，此外，法院認定同案付費會員下載MP3的行為構成犯罪。不過，與Kuro一樣提供MP3下載的ezPeer網站，負責人一、二審均獲判無罪，顯示相關案件在法律上的爭議仍高，全案除會員外，仍可上訴最高法院。</P><P>
一審時，飛行網董事長陳壽騰徒刑二年、執行長陳國華及總經理陳國雄徒刑各三年，三人及公司均各併科及科罰金三百萬元。高院審酌他們已和部分音樂人達成和解，且近年來致力於著作權保護工作，加上適用減刑條例，陳壽騰改判六個月、併科罰金七十五萬，緩刑四年；陳國華及陳國雄各處九個月徒刑，併科罰金七十五萬元。</P><P>
飛行網公司要被科罰金七十五萬元；大量下載歌曲的會員陳佳惠則處徒刑四十五天，得易科罰金，緩刑三年。</P><P>
曾經號稱擁有五十萬會員的飛行網公司，從八十九年七月開始，以「點對點」（Peer to Peer，簡稱P2P）檔案分享軟體及網站主機，提供會員傳輸及下載MP3影音檔案；會員月繳九十九元或半年五百元，就可使用下載。</P><P>
判決指出，飛行網未經滾石等十餘家唱片公司同意，將這些公司擁有版權的歌曲違法重製成MP3，在網站供會員下載，又在雅虎等網站刊登「五十萬首最新MP3，無限下載」等廣告，吸引網友加入會員。高院認為，陳壽騰等人為求快速擴充可供交換MP3檔案以招覽會員，共同以非法公開傳輸、重製方式侵害他人著作財產權。  </P></DIV>
