At the time section 109 covered such "threshold pollutants" like ozone. Threshold pollutants are those that are a threat above a certain threshold concentration level, but not below that level. Later, we discovered that many threshold pollutants (ozone included) were actually threats at any level above zero concentration. So, now what. Many of the previously thought to be threshold pollutants are naturally occurring. Can't get rid of them. So the EPA is unable to set standards that "protect the public health within an adequate margin of safety". So they make them up. They are arbitrary. The margin of protection is zero for some of these pollutants.
