 <TABLE cellspacing="0" class="left"><TBODY><TR><TD><LABEL><A href="http://tw.news.yahoo.com/photo/url/d/i/080709/8/20080709_1872275/20080709_1872275.jpg.html" title=""><IMG src="http://l.yimg.com/tw.image.news.yahoo.com//xp/tvbs/20080709/14/3050282487.jpg" /></A></LABEL></TD></TR></TBODY></TABLE><P>台北市一名小六女童，在知名網站<A title="YouTube" class="ynwsyq yqclass" href="?" id="yui-gen0"><SPAN>YouTube</SPAN></A>搜尋到最喜歡的<A title="日本" class="ynwsyq yqclass" href="?" id="yui-gen1"><SPAN>日本</SPAN></A>卡通「魔女的考驗」，還把影片連結放在自己的<A title="部落格" class="ynwsyq yqclass" href="?" id="yui-gen2"><SPAN>部落格</SPAN></A>上，因此被卡通代理商告進法庭，法官念在少女是初犯且行為輕微，裁定交由父母管教不需審判，但事後家長又接到代理商索賠文件，讓女童母親大罵，代理商太過分。</P><P>女童母親：「我們當庭就認錯，也慎重就是說道歉，只是我不能理解的是，對方之後又來一個函，指責我們嚴重侵害，嚴重侵害，又要我們10日內去跟他們主動聯繫，要求賠償。」</P><P>從網路上搜尋到自己最愛的日本卡通「魔女的考驗」，小六女童高興把影片連結貼在自己的部落格里，卻因此觸犯著作權法，惹來卡通代理商提出告訴。</P><P>女童母親：「非常沮喪不再看這個卡通，任何關於這個卡通的，名字、影片、圖片，她都不再碰觸，對她的心靈傷害是很大的。」</P><P>女童母親說，少年法庭法官念在小女童是初犯有悔改意思，而且行為輕微，裁定交由父母管教不需審判，他不懂代理商怎麼在這之後還來索賠，難道警局做筆錄、法院出庭，不足以給一個12歲的孩子教訓嗎？</P><P>卡通代理商蔡先生：「他們去抓到網路上的IP位置，不曉得是個小孩子，都不清楚，到目前為止也沒有跟他們索賠。」</P><P>孩子有錯在先，女童母親坦承自己管教有疏失，也同意業者有權利主張自己的權益，只是身為卡通代理商該是給小朋友歡樂，維護著作權的方式，以不需要這麼強硬，嚇壞孩子。</P></DIV></DIV></blockquote></div><div style="margin: 0px 6px 6px 4px;"><table style="font-size: 11px;border-spacing: 0px;padding: 0px;" cellpadding="0" cellspacing="0" width="100%"><tr><td style="background:transparent;border-width:0px;padding:0px;">&nbsp;</td><td align="right" style="background:transparent;border-width:0px;padding:0px;width:107px" width="107"><a href="http://clipmarks.com/share/96FEB088-2D12-4EC3-8BA9-E025826FFC1A/blog/" title="blog or email this clip"><img src="http://content9.clipmarks.com/images/c2b-foot.png" border="0" alt="blog it" width="107" height="17" style="border-width:0px;padding:0px;margin:0px;" /></a></td></tr></table></div></div>
