Another tidbit from another TV station:

But Judge Banales ruled that he cannot allow Guerra prosecute the case because he is one of the victims in the indictments.

While there is surely more to this in a legalistic analysis, it would seem to me that ANY citizen could qualify as a victim of the indictment. This is a very exciting case.
