Specifically the 4th and 5th amendments, and Posse Comitatus, which forbids the use of military for domestic policing.

The dangerous plea of "necessity" and "war powers" was used. In other words, the Constitution was suspended (in factual actions) and America was under secret Martial Law.

Love the Monday morning quarterbacking that goes on re the aftermath of 9-11. Do you remember the chaos?

I'm no fanboy of GW, but say what you will...WE HAVE HAD ZERO ATTACKS SINCE 9-11 !!!

Maybe we should be looking at the "constitutionality" of what our new "leader" is doing regarding the rape and plunder of our economy!

Actually we know that surveillance on Americans began before 9/11. It is surely more important than a football analogy when any President (including Obama) decides to circumvent the Constitution, particularly under the pretense of "defending freedom". No Constitutution, no freedom.

This article currently high on Digg sums it up well:

Bush's Secret Dictatorship
voices.washingtonpost.com — : "We may not have realized it at the time, but in the period from late 2001-January 19, 2009, this country was a dictatorship. The constitutional rights we learned about in high school civics were suspended. That was thanks to secret memos crafted deep inside the Justice Department that effectively trashed the Constitution."
