Indifference is not the issue. People involved in the bystander effect are not indifferent to the pain or suffering of another, they feel less inclined to be responsible given the large numbers of people - That does not make them or their inaction complicit in another's criminal act. As numbers decrease, the probability of the bystander effect decreases.

There is a similar occurrence in larger, less dramatic circumstances like social responsibility where people do not act because of feelings of futility - ex. 'my one vote won't make a difference'.
