I have read and re-read the federalist papers, it is still hard to get a clear picture of what the intent was, but I doubt that this was it. Reading the wiki article, http://en.wikipedia.org/wiki/Commerce_Clause is also informative because it links various cases involving this, and also had led me to this, http://federalistblog.us/2006/08/busting_congress_interstate_commerce_myth.html which is also informative. My conclusion is that it will be very tough to declare these actions unconstitutional. |
