The U.S. Constitution must be just a museum piece to these people.

I think this is more related to the broad interpretation of Article 1, Section 8, "to regulate commerce". I have read and re-read the federalist papers, it is still hard to get a clear picture of what the intent was, but I doubt that this was it. which is also informative. My conclusion is that it will be very tough to declare these actions unconstitutional.
