I mean, Obama is breaking his promises right on que.

It is more than just Obama, although now the ball in his court, no more punting to the last administration on this issue. This is what happens when the balance between the three branches collapses. Once the powers were given to the Executive Branch, no President (except maybe George Washington himself) would walk away from them.

Congress aided and abetted the Bush administration in the creation of the Imperial Executive, Obama runs with it and the Courts have self neutered themselves. Catastrophic failure all around. This is the real threat to freedom, not the fantasies of socialism/fascism that the right harps about.
