Do we have proof that this conduct created an uncomfortable or hostile environment to their co-workers? Because one thing is to create such an environment, and quite another to have an simple office romance. The burden of proof is heavier than the simple wording of the law appears to be, especially in the eyes of laymen.

Has to be, otherwise it would turn all working environments into repressive/hostile areas. I mean "never mix work with pleasure" is good advice but it's just that, advice.

I know that Rush Limbaugh once said "women actually wish for sexual harassment" and boasted that a sign on his office door read, "Sexual harassment at this work station will not be reported. However...it will be graded!!!" Seemed the press gave him a pass on those.
Bill O'reilly's sexual harassment issue was sure swept under the rug pretty fast, and resulted in his ratings going up, even though he never apologized and continued to claim it was false, he paid millions to the victim as an out-of court settlement.

Not to defend Letterman, but at least it appeared consensual and he has apologized and owned up to what he did as being wrong.

There is a saying which goes:

"A young man tries to be faithful but he can't. An old man tries to be unfaithful, but he can't."

Letterman falls into the category of the latter. If not for the power of his position, he would have to feign faithfulness, though it would actually be for lack of opportunity.
