Exactly. One of the reasons I clipped this was because I was reading a lot of clips that claimed the majority of Americans now support gay marriage, which is absurd because if they did then why didn't they have a vote? Why did they feel they needed 4 judges to overturn the will of the voters? As you can see that's not the case.

The reason is because the laws as is are discriminatory. The majority of people in this country wanted to keep slavery going but it was made illegal by the courts. If you follow your thought, we should have kept slavery until there could be a vote where the majority of people voted against it.

What I do have a problem with, is the courts that keep overriding the will of the voters who oppose it and making it law. The judges are there to interpret laws, not create them.
I don't think this argument will work with the California decision. In November Californians will have the opportunity to approve a resolution that would amend the state constitution defining marriage to be between a man and a woman and thus overriding the court's decision. It seems to be a reasonable check to the court's power.

WRONG. First of all I don't even think it was a "minority vs majority" in the case of slavery in the U.S. The North wanted the South to end slavery, but instead of giving them the help they needed to wean themselves off of plantations (which required slave labour), they instead demanded that the slavery end immiediately. Hypocritical considering the fact that the north was itself taking ...
