So I have to say, I agree with Sprint on this one - not the consumers.

While those 2-year service agreements annoy me too, they do allow me to buy cheap phones and always have the latest gadgets, which I love.

If they aren't allowed to lock us into 2-year contracts, they're going to stop subsidizing phones and will raise the prices on their services, which I don't think any of us wants either.

As a compromise, why not require them to offer options. If you sign a 2-year contract, they'll offer you subsidized phone and service pricing. If you don't want to be locked into a contract, you can do that, but you'll pay more for your phones and service.

That way, those of us who are ok with dealing with 2 year contracts to keep our prices low can do so, while those of us that don't mind paying more to keep their options open can do so as well.

To me it's a win-win.
