<FONT size="5"><B>總</B></FONT>統當選人<A class="cidkligk" target="_blank" title="搜尋這個關鍵字的相關內容" href="http://www.contentinside.net/redirkey.aspx?wid=1&kw=%u99AC%u82F1%u4E5D">馬英九</A>涉及的特別費案，最高法院今（二十四）日下午宣判，最高法院駁回檢方上訴，也就是說，最高法院支持一、二審無罪理由，認定<A class="cidkligk" target="_blank" title="搜尋這個關鍵字的相關內容" href="http://www.contentinside.net/redirkey.aspx?wid=1&kw=%u99AC%u82F1%u4E5D">馬英九</A>無罪，全案也已經定讞。

最高法院書記官長張淳淙表示，在今年一月三十日收到卷證資料，經過一般審理程序，最後決定駁回檢方上訴。張淳淙並說明，三審只就<A class="cidkligk" target="_blank" title="搜尋這個關鍵字的相關內容" href="http://www.contentinside.net/redirkey.aspx?wid=1&kw=%u6CD5%u5F8B">法律</A>進行審理，不就事實進行審理。張淳淙並表示，馬英九主觀上沒有違法的意圖，客觀上會計上也沒有違法的事實，因此認定無罪。至於余文部份，則維持原判，認定有偽造文書的。

檢方當時在起訴時指出，馬英九從民國87年12月到95年7月為止，總計詐領特別費1千117萬多元，因此依照貪污罪嫌將馬英九起訴。

不過，一、二審法院都判決馬英九無罪。高院在判決中還指出，特別費具有補貼的性質；同時高院也認為，領據特別費的方式已經形成行政慣例，馬英九也有權在具領後，統籌支配運用這筆款項，加上馬英九確實已經將所領取的領據特別費全數因公支用完畢，沒有取得任何不法財物，高院因此馬英九不構成貪污。而最高法院支持二審看法，駁回檢方上訴。
