That is why I could not support the bill that passed Congress. The bill does not adequately protect the privacy rights of Americans. I was also troubled that the bill will have the effect of providing immunity to telecommunication companies that knowingly participated in the President's illegal spying of American citizens. request for assistance because they believed it was clearly illegal and unconstitutional. Current law, moreover, already provides immunity from civil liability to telecommunications companies who participated in good faith, and courts have the ability to determine if that was the case.

To provide immunity to companies who did not comply with the law would set a very troubling precedent and would serve as a disincentive for companies to follow the law in the future. For these reasons, I cosponsored an amendment to strip immunity from the bill. Unfortunately, that amendment was defeated.
