If Congress AUTHORIZED the TRANSFER of power to the executive branch, how is it illegal? The Constitution only species who holds the power, not the transfer of it. It would be another story all together if they did not transfer it, but they did.

But, even with the power to declare war, he can still send troops as a "police action" correct? He can fight a war and just not declare it (Kinda like he is doing now).

Congress can not delegate essential Constitutional powers as it will strip it bare of its Constitutional responsibilities. Delegations of power have to be clear, concise and total and can be reversed by an act of Congress.
