Wisco says: The main question here is whether the majority can take rights from away the minority. Forget about gays and marriage, can Californians take voting rights from people, for example? The question is much broader than this one case, as would be the consequences. It could easily be argued that, if Prop. 8 is allowed to stand, Californians have no rights -- at least, not as far as the state constitution is concerned -- they only enjoy privileges that can be taken away by a simple majority vote at any time. |
